Ext.P3<\/p>\n<p>is   the   order   of   the   DPI   by   which   appointment   of   the   fourth<\/p>\n<p>respondent   is   seen   approved   from  08-06-2005   to   7-6-2008.       No<\/p>\n<p>decision has been taken regarding the approval of the appointment<\/p>\n<p>of the petitioner.\n<\/p>\n<\/p>\n<p>      2.     The relief sought for in the writ petition is to direct the<\/p>\n<p>third   respondent   to   consider   the   approval   of   appointment   of   the<\/p>\n<p>petitioner   as  U.P.S.A   in  the   light   of   the   decision   of   the  Division<\/p>\n<p>Bench of this court in <a href=\"\/doc\/1500315\/\">Padmanabhan Nambiar v. Government of<\/p>\n<p>Kerala<\/a> (1997(2)KLT 725) and to pay arrears of salary.<\/p>\n<p>      3.     I   heard   learned   counsel   for   the   petitioner,<\/p>\n<p>Sri.Goplakrishnan   Nair   for   respondent   No.4   and   learned<\/p>\n<p>Government Pleader also. There is no dispute that Ext.P3 has been<\/p>\n<p><span class=\"hidden_text\">WPC No.6418\/07                               2<\/span><\/p>\n<p>set aside by the Government and the matter is no doubt challenged<\/p>\n<p>by the fourth respondent in the writ petition filed here.   Whatever<\/p>\n<p>that   be,   the   writ   petition   is   disposed   of   directing   the   third<\/p>\n<p>respondent to consider and take a decision on the question relating<\/p>\n<p>to   approval   of   the   appointment   of   the   petitioner   on   the   basis   of<\/p>\n<p>Ext.P1 order of appointment in accordance with law after hearing<\/p>\n<p>the petitioner, fourth respondent and  Rev.R.Vijayakumar, who has<\/p>\n<p>been approved as manager by the Government, within a period of<\/p>\n<p>two months from the date of receipt of a copy of this judgment.
