S. Verma applied to CPIO Shri Tarun<br \/>\nKumar, Jr. Secretary, Central Information Commission, seeking the following<br \/>\ninformation regarding his special leave for appeal to review and appeal u\/s 18 (1)\n<\/p>\n<p>(e):\n<\/p>\n<p>       &#8220;1.     Registration No. of appeal.\n<\/p>\n<p>2.             Status of appeal.\n<\/p>\n<p>3.             Defect(s) \/ deficiency(ies) in the appeal, if any, which need to<br \/>\nbe rectified by appellant.&#8221;\n<\/p>\n<p>         To this, Shri R. S. Verma received a response dated 2.3.09 from Shri M.<br \/>\nC. Sharma, Assistant Registrar informing him as follows:\n<\/p>\n<blockquote><p>      &#8220;It is informed that with regard to your special leave for appeal to<br \/>\n      review the decision dated 1.12.2008, a reply has already been sent<br \/>\n      to you vide our letter No. CIC\/MA\/A\/2008\/00942 dated 24.2.2008<br \/>\n      (copy enclosed for your reference)\n<\/p><\/blockquote>\n<blockquote><p>      a)       No separate Registration is given on applications for review.\n<\/p><\/blockquote>\n<p>b)             Your application for Review stands disposed of.\n<\/p>\n<p>c)             No information can be given in view of the position explained<br \/>\nabove.&#8221;\n<\/p>\n<p>         Not satisfied with this response, Shri Verma appealed before Shri<br \/>\nMohammad Haleem Khan, Secretary &amp; First Appellate Authority, Central<br \/>\nInformation Commission on 16.3.09 pleading that &#8220;in view of the above, the<br \/>\ninformation provided vide letter dated 24.2.09 to the effect that &#8220;your application<br \/>\nfor Review stands disposed off&#8221; is believed to be incorrect, incomplete and<br \/>\nmisleading.&#8221;\n<\/p>\n<p><span class=\"hidden_text\">                                           1<\/span><\/p>\n<p>          Upon this, by his order of 26.5.09, Appellate Authority Shri L. C. Singhi,<br \/>\nRegistrar, Central Information Commission has directed as follows:\n<\/p>\n<blockquote><p>         &#8220;On perusal of the file, it is found that Shri M. C. Sharma, Assistant<br \/>\n         Registrar, Central Information Commission in response to<br \/>\n         appellant&#8217;s RTI application has provided whatever information was<br \/>\n         available with him on record and that there was no denial<br \/>\n         whatsoever. It also cannot be stated that the information provided<br \/>\n         was &#8220;incomplete&#8221; in any manner. The appellant may, if he so<br \/>\n         desires, inspect the file in order to obtain the requested information<br \/>\n         during the working hours of the Commission. Shri M. C. Sharma,<br \/>\n         Assistant Registrar, Central Information Commission is directed to<br \/>\n         show the concerned file to the appellant for his inspection.&#8221;<\/p><\/blockquote>\n<p>         This order was passed subsequent to a notice of hearing issued on<br \/>\n11.5.09 requesting the appellant to appear in person on 20.5.09. The Registrar<br \/>\nhas noted that &#8220;the appellant did not appear in person to submit his arguments.<br \/>\nAs no telephone number of the appellant was available on record, he could not<br \/>\nbe contacted telephonically. The matter was, therefore, decided ex parte based<br \/>\non the material available on record.&#8221;\n<\/p>\n<p>         Appellant Shri R. S. Verma&#8217;s prayer in second appeal before us is as<br \/>\nbelow:\n<\/p>\n<blockquote><p>         &#8220;It is very humbly requested that CPO \/ Ist Appellate Authority<br \/>\n         are directed to furnish complete and correct information<br \/>\n         without charging any fee.&#8221;<\/p><\/blockquote>\n<p>         However, this is based on the plea in the second appeal moved on<br \/>\n21.4.09 i.e. before the orders in First Appeal, that &#8220;Response has not been<br \/>\nreceived from 1st Appellate Authority so far although more than 30 days have<br \/>\npassed.&#8221;\n<\/p>\n<p>         The appeal was heard by videoconference on 7.7.2010. The following are<br \/>\npresent:\n<\/p>\n<blockquote><p>         Appellant at NIC Studio, Ranchi<br \/>\n               Shri R. S. Verma<br \/>\n         Respondents at CIC Studio, New Delhi<br \/>\n               Shri Tarun Kumar, Jt. Secy. &amp; F.A.A.<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                           2<\/span><\/p>\n<p>               Shri M. C. Sharma, US &amp; CPIO<\/p>\n<p>       Shri Tarun Kumar submitted that the appeal was received on 26.3.&#8217;09<br \/>\nafter which the Appellate Authority has changed, which accounted for the delay<br \/>\nin responding to the First Appeal by the Appellate Authority Shri L. C. Singhi.<br \/>\nRespondent Shri M. C. Sharma submitted that in fact the applicant&#8217;s petition for<br \/>\nsubmitting Special Leave Petition to review the decision on the various grounds<br \/>\nhad been responded to on 24.2.09, as follows:\n<\/p>\n<blockquote><p>       &#8220;This is with reference to your application No. nil dated 1.12.2008<br \/>\n       submitted to the Commission to review the decision of CIC. In this<br \/>\n       connection, it is informed that you should inspect the records and<br \/>\n       obtain the information. You may approach the Commission again,<br \/>\n       if any information is refused. It is again pointed out that there is no<br \/>\n       provision under the Act for redressal of the grievances relating to<br \/>\n       service matter.&#8221;<\/p><\/blockquote>\n<p>       Appellant Shri Verma on the other hand submitted that he has not<br \/>\nreceived any response to the SLP to review the petition and appeal u\/s 18(1)(e)<br \/>\nsubmitted on 12.1.08.\n<\/p>\n<p>                               DECISION NOTICE<\/p>\n<p>       The correspondence in appeal No. CIC\/MA\/A\/2008\/00942 has been<br \/>\nexamined. Insofar as the response of 24.2.09 is concerned, which purports to<br \/>\ndispose of the petition of 1.12.08, the letter of Assistant Registrar Shri M. C.<br \/>\nSharma does not even mention the request for review or appeal u\/s 18(1)(e) but<br \/>\nstraightway offers inspection of records, which have not even been asked for.<br \/>\nFrom a perusal of the records, however, it is clear that this offer has been made<br \/>\nas a facility in case appellant Shri Verma was not satisfied with the decision and<br \/>\nits compliance. To clarify this position, therefore, file noting on page 3-N of file<br \/>\nNo. CIC\/MA\/A\/2008\/00942, which discusses this petition and carries the orders<br \/>\nof IC Shri M. M. Ansari on that petition, will be conveyed to appellant Shri Verma<br \/>\ntogether with this decision notice. The appeal is thus allowed to this extent<\/p>\n<p><span class=\"hidden_text\">                                         3<\/span><br \/>\n        Although, therefore, we hold that in fact the CPIO Shri M. C. Sharma has<br \/>\nindeed supplied the information sought by appellant Shri Verma to him, Assistant<br \/>\nRegistrar, it is also correct that the information supplied was not complete. There<br \/>\nis no evidence to show, however, that such incomplete information was<br \/>\n&#8216;knowingly&#8217; given, which would have rendered CPIO subject to a penalty. There<br \/>\nwill therefore be no cost.\n<\/p>\n<p>       Reserved in the hearing to enable examination of the original file, this<br \/>\ndecision is announced in open chambers on this 13th day of July, 2010.
