No.2649 of 2011, whereby a prayer<\/p>\n<p>                   has been made to amend the relief portion<\/p>\n<p>                   to the extent of amending the prayer for<\/p>\n<p>                   granting merger of 50% Dearness Relief in<\/p>\n<p>                   the main prayer portion.\n<\/p>\n<p>                              The petition stands allowed.\n<\/p>\n<p>                              The    petitioner,      who    retired      from<\/p>\n<p>                   the   post        of     librarian       In-Charge       of<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>Tilkamanjhi               Bhagalpur                  University,<\/p>\n<p>Bhagalpur,         has    prayed        for    directing         the<\/p>\n<p>respondents to pay his retirement dues in<\/p>\n<p>view of U.G.C. scale (revised pay scale)<\/p>\n<p>and further for directing to calculate the<\/p>\n<p>pension as per last salary drawn by the<\/p>\n<p>petitioner,         arrear       of     Leave        Encashment,<\/p>\n<p>Arrear amount of Gratuity, Arrear amount of<\/p>\n<p>Provident         Fund,   Arrear        amount       of   Welfare<\/p>\n<p>fund, Arrear of difference amount of salary<\/p>\n<p>as     per    U.G.C.      scale         and     also      as     per<\/p>\n<p>amendment         petition,        merger        of       50%     of<\/p>\n<p>Dearness Relief on basic pay.\n<\/p>\n<p>             So far as merger of 50% Dearness<\/p>\n<p>Relief       is   concerned,       the        petition      stands<\/p>\n<p>allowed in view of order dated 3.12.2010<\/p>\n<p>passed       in   C.W.J.C.       No.3616        of    2010      (Dr.<\/p>\n<p>Himanshu Bhushan Vs. Tilkamanjhi Bhagalpur<\/p>\n<p>University and others) and other connected<\/p>\n<p>writ petitions. Regarding remaining relief,<\/p>\n<p>the petitioner is granted liberty to file a<\/p>\n<p>fresh        representation             before        respondent<\/p>\n<p>no.2\/Vice Chancellor, Tilkamanjhi Bhagalpur<\/p>\n<p>University         within    a    period        of    six      weeks<\/p>\n<p>from     today.      If     such        representation            is<\/p>\n<p>filed,       respondent          no.2     is     required         to<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>        examine the same and pass appropriate order<\/p>\n<p>        in     accordance        with   law    redressing     the<\/p>\n<p>        grievance of the petitioner within a period<\/p>\n<p>        of three months from the date of filing of<\/p>\n<p>        such    representation.
