He has submitted<br \/>\nthat investigation is over and charge-sheet is filed. He has<br \/>\ncontended that from the charge-sheet papers no prima facie case is<br \/>\nmade out against the present applicant. He has contended that<br \/>\nco-accused are released on bail. He has contended that hard-disk,<br \/>\nwhich was recovered from the present applicant was sent for the FSL<br \/>\nreport and report of the FSL is obtained. He has contended that from<br \/>\nthe FSL report nothing is found against the present applicant. He has<br \/>\nprayed to release applicant on bail.\n<\/p>\n<p>3.\tHeard<br \/>\nMs.Chetna Shah, learned APP for the respondent State. She has read<br \/>\ncharge-sheet papers and argued that looking to the seriousness of the<br \/>\noffence present applicant is not required to be released on bail. She<br \/>\nhas vehemently opposed the present application.\n<\/p>\n<p>4.\tFSL<br \/>\nreport is produced on record today. I have verified the report. It<br \/>\nappears that co-accused on the same footing are released on bail.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned Counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, statement of the witnesses, gravity of<br \/>\nthe offence and quantum of punishment and the fact there is no<br \/>\ndefinite allegation made against the applicant, I am inclined to<br \/>\ngrant bail to the applicant.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe above, this Application is allowed. The applicant is ordered to<br \/>\nbe released on bail in connection with CR No.I-112 of 2010 registered<br \/>\nwith Kamlabaug Police Station, Dist. Porbandar for the offence<br \/>\nalleged against him in this Application on his executing a Bond of<br \/>\nRs.10,000\/- (Rupees ten thousand only) with one solvent surety of the<br \/>\nlike amount to the satisfaction of the trial Court and subject to the<br \/>\nconditions that he shall-\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge;\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>g)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nthe breach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
