Civil Second Appeal No.3647\/2004 (DR-J).<\/p>\n<p>Date of Order :                     July 28, 2008<\/p>\n<p>             HON&#8217;BLE DR. JUSTICE VINEET KOTHARI<\/p>\n<p>Mr. C.S. Rajpurohit for the appellant.<\/p>\n<p>         Heard learned counsel.\n<\/p>\n<p>         The learned counsel submitted that since the appellant had<\/p>\n<p>gone out of station and was not informed timely about the decision<\/p>\n<p>of the first appeal the delay in filing the second appeal arose.   The<\/p>\n<p>delay in question is of 583 days.    Respondents have filed reply to<\/p>\n<p>the application under Section 5, Limitation Act denying the<\/p>\n<p>averments made in the application.\n<\/p>\n<p>         In the said reply, it has been submitted that the defendant<\/p>\n<p>appellant was not prosecuting the first appeal and, therefore, there<\/p>\n<p>is no good reason to condone such huge delay in filing the second<\/p>\n<p>appeal.\n<\/p>\n<p>         Upon perusal of the averments made in the application filed<\/p>\n<p>under Section 5, Limitation Act, this Court is satisfied that no<\/p>\n<p>proper reason is made out by the appellant for condonation of the<\/p>\n<p>delay.     Even though liberal approach is taken it does not mean<\/p>\n<p>that the delay has to be condoned as a matter of right.        Unless<\/p>\n<p>cogent reasons are made out before the Court such leniency may,<\/p>\n<p>on the other hand, seriously prejudice the rights of the other party<\/p>\n<p>and put a premium on the lethargy and delay caused by the<\/p>\n<p>appellants in approaching the Court.\n<\/p>\n<p>         Even otherwise, scope of the second appeal is much<\/p>\n<p>narrowed down after amendment in the Civil Procedure Code and<\/p>\n<p>only on a substantial question of law this second appeal can be<br \/>\n maintained.\n<\/p>\n<p>       Having heard the learned counsel, this Court does not find<\/p>\n<p>any good ground made out for condonation of the delay.
