JUSTICE SABINA\n\n\nPresent:   Mr.Rakesh Nehra, Advocate,\n           for the appellant.\n\n                 ****\n\nSABINA, J.\n<\/pre>\n<p>           Plaintiff Suraj Bhan filed a suit for possession, which was<\/p>\n<p>decreed by the Civil Judge (Jr.Divn.) Bahadurgarh vide judgment and<\/p>\n<p>decree dated 24.12.2004. In appeal filed by defendants No.1 and 2,<\/p>\n<p>the said judgment and decree were upheld by the Additional District<\/p>\n<p>Judge-I, Jhajjar vide judgment and decree dated 4.3.2008. Hence,<\/p>\n<p>the present appeal by defendant No.1.\n<\/p>\n<p>           Brief facts of the case, as noticed by the lower appellate<\/p>\n<p>Court in para Nos. 2 and 3 of its judgment, are as under:-<br \/>\n<span class=\"hidden_text\"> R.S.A.No. 3443 of 2008                                   2<\/span><\/p>\n<blockquote><p>          &#8220;2.        Briefly stated the facts of the case as<\/p>\n<p>          emanating from the pleading of the parties are that the<\/p>\n<p>          plaintiff and the defendants No.5 to 12 were owners in<\/p>\n<p>          possession of the plot No.387 measuring 4 kanals 1<\/p>\n<p>          marla comprised in khewat No.364\/344 and Khatoni<\/p>\n<p>          No.463 situated within the revenue estate of village<\/p>\n<p>          Bhaproda, Tehsil Bahadurgarh as per the jamabandi for<\/p>\n<p>          the year 1996-97.       The defendants No.1 to 4 were<\/p>\n<p>          alleged to have encroached upon this plot on the area<\/p>\n<p>          shown with letters ABCDE, EDGF, DCHG and CIH<\/p>\n<p>          respectively in the site plan Ex.P3. They were alleged to<\/p>\n<p>          have raised illegal structures thereon in December 1999.<\/p>\n<p>          When they did not remove the illegal structure therefrom<\/p>\n<p>          the plaintiff brought the present suit seeking a decree for<\/p>\n<p>          possession of the above area allegedly encroached upon<\/p>\n<p>          by the defendants No. 1 to 4.\n<\/p><\/blockquote>\n<blockquote><p>          3. The defendants No. 1, 2 and 3-A having put up<\/p>\n<p>            appearance filed their written statement.         Therein,<\/p>\n<p>            besides raising certain legal objections they pleaded<\/p>\n<p>            that they did not encroach upon any portion of the<\/p>\n<p>            above plot No.387.     They claimed themselves to be<\/p>\n<p>            owners in possession of the above portions.          They<\/p>\n<p>            further pleaded that these portions had fallen to their lot<\/p>\n<p>            in the year 1953 and since that day they have been in<br \/>\n<span class=\"hidden_text\"> R.S.A.No. 3443 of 2008                                       3<\/span><\/p>\n<p>                 possession thereof after raising the construction<\/p>\n<p>                 thereon. They further pleaded that the alleged portions<\/p>\n<p>                 formed part of plot No.1497 and the plaintiff and the<\/p>\n<p>                 proforma defendants No. 5 to 12 have nothing to do<\/p>\n<p>                 with the title or possession of these portions.      With<\/p>\n<p>                 these averments these defendants prayed for dismissal<\/p>\n<p>                 of the suit.   Defendants No. 5 to 12 in their written<\/p>\n<p>                 statement admitted the claim of the plaintiff in toto.<\/p>\n<p>                 Defendant No.4 also admitted the claim of the plaintiff<\/p>\n<p>                 in toto as per his statement given after putting up<\/p>\n<p>                 appearance before the lower court.&#8221;<\/p><\/blockquote>\n<p>           On the pleadings of the parties, following issues were<\/p>\n<p>framed by the trial Court:-\n<\/p>\n<blockquote><p>            &#8220;1.           Whether the plaintiff is entitled to a decree for<\/p>\n<p>            possession in his favour and against the defendants on<\/p>\n<p>            the grounds as alleged in the plaint? OPP<\/p>\n<\/blockquote>\n<blockquote><p>            2.            Whether the suit of the plaintiff is not<\/p>\n<p>            maintainable in the present form? OPD<\/p>\n<\/blockquote>\n<blockquote><p>            3.            Whether the suit is bad for mis-joinder and<\/p>\n<p>            non-joinder of necessary parties? OPD<\/p>\n<\/blockquote>\n<blockquote><p>            4.            Whether the plaintiff has nocause of action to<\/p>\n<p>                 file the present suit? OPD<\/p>\n<\/blockquote>\n<blockquote><p>            5.            Whether the plaintiff has no locus-standi to file<\/p>\n<p>                 the present suit? OPD<br \/>\n<span class=\"hidden_text\"> R.S.A.No. 3443 of 2008                                      4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>           6.          Whether the plaintiff has not come in the court<\/p>\n<p>           with clean hands? OPD<\/p>\n<\/blockquote>\n<blockquote><p>           7.          Whether     the   defendants   are     owners   in<\/p>\n<p>           possession of a suit land since 1953 from the time of<\/p>\n<p>           partition of abadi of village, as detailed in para No.4 of<\/p>\n<p>           the written statement ? OPD<\/p>\n<\/blockquote>\n<blockquote><p>           8.          Relief. &#8220;<\/p><\/blockquote>\n<p>           After hearing learned counsel for the appellant, I am of<\/p>\n<p>the opinion that the instant appeal is devoid of any merit.<\/p>\n<p>           The case of the plaintiff was that the plaintiff and<\/p>\n<p>defendants No. 5 to 12 were owners of the plot No.387. Defendants<\/p>\n<p>No. 1 to 4 had, however, encroached upon the plot over the area<\/p>\n<p>marked with letters ABCDE, EDGF, DCHG and CIH as shown in the<\/p>\n<p>site plan Ex.P-3.    In order to substantiate their case, plaintiffs<\/p>\n<p>examined PW-4 Raghbir Singh, Halqa Girdawar. The said witness<\/p>\n<p>deposed that on 3.9.2000, he was posted as Halqa Girdawar in<\/p>\n<p>village Bhaproda . He had demarcated plot No.387 in the presence<\/p>\n<p>of the parties to the suit, Halqa Patwari and other respectables of the<\/p>\n<p>village. The said witness proved his report Ex.P4, attendance sheet<\/p>\n<p>Ex.P-5 and site plan Ex. P-6.       PW-4, in his cross-examination,<\/p>\n<p>deposed that the defendants had not affixed their signatures on the<\/p>\n<p>report. The said witness in his report opined that there was illegal<\/p>\n<p>encroachment on the part of defendants Chand Ram, Dharambir and<\/p>\n<p>Tekan.\n<\/p>\n<p><span class=\"hidden_text\"> R.S.A.No. 3443 of 2008                                     5<\/span><\/p>\n<p>              Learned trial Court, after perusing the attendance sheet<\/p>\n<p>Ex.P-5, has observed that as per the same, the demarcation was<\/p>\n<p>conducted in the presence of respectables of the village apart from<\/p>\n<p>the parties to the suit.       In order to counter the said report,<\/p>\n<p>defendants, on the other hand, examined DW-4 Satpal Singh,<\/p>\n<p>Kanungo, who has submitted his demarcation report Ex.DW 4\/A. As<\/p>\n<p>per the said witness,        construction had been raised by the<\/p>\n<p>defendants in plot     No.1497\/1 and 2.    However, the said witness<\/p>\n<p>admitted that he had not given any notice to the plaintiff at the time of<\/p>\n<p>demarcation. In these circumstances, the learned Additional District<\/p>\n<p>Judge, rightly held that no reliance could be placed on the reports<\/p>\n<p>submitted by DW-4 as the demarcation had been done at the back of<\/p>\n<p>the plaintiff. The finding of fact arrived at by both the Courts below<\/p>\n<p>after appreciating the evidence on record, calls for no interference by<\/p>\n<p>this Court.\n<\/p>\n<p>              No substantial question of law arises in this regular<\/p>\n<p>second appeal.
