No.34869 of 2008\n    Krishna Kumar Sharma, Son of Ram Prasad Sharma, Resident of Village Bairiya Bakuntrhpuri,\n                         PS Ahiyapur, District Muzaffarpur --- Petitioner\n                                             Versus\n                             The State Of Bihar ---- Opposite Party\n                                            -----------\n<\/pre>\n<p>2         11.7.2011                        The petitioner is aggrieved by the order dated<\/p>\n<p>                             17.4.2008 passed in Sessions Trial No. 463 of 2005 by which<\/p>\n<p>                             there is a prayer that P.Ws. 1 and 2 should be recalled as defence<\/p>\n<p>                             witnesses to examine them on the point of identification.<\/p>\n<p>                                           On perusal of the order, it appears that the defence<\/p>\n<p>                             had the opportunity to cross-examine the witnesses and as such<\/p>\n<p>                             if there is any lacuna in the cross-examination, the Court<\/p>\n<p>                             obviously cannot grant the leave to the defence to avail<\/p>\n<p>                             opportunity for covering up the lacunas in the case.<\/p>\n<p>                                           In the result, this application is dismissed.<\/p>\n<pre>Sanjay                                                          (Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Krishna Kumar Sharma vs The State Of Bihar on 11 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
