Petitioner is the first accused in the crime. The de<\/p>\n<p>facto complainant filed a private complaint before the<\/p>\n<p>Magistrate Court and it was forwarded to the police under<\/p>\n<p>Section 156(3) Cr.P.C and a crime was registered under<\/p>\n<p>Sections 341, 498(a), 506(II) read with 34 of Indian Penal<\/p>\n<p>Code against three persons. Petitioner is the first accused. It is<\/p>\n<p>alleged that the accused iltreated the de facto complainant and<\/p>\n<p>the first accused did not show any interest in sexual<\/p>\n<p>relationship. He also told her that he is interested in<\/p>\n<p>homosexual activities etc.<\/p>\n<p>      2. Learned counsel for petitioner submitted that the<\/p>\n<p>allegations in the complaint are false. Marriage between the<\/p>\n<p>petitioner and the de facto complainant was solemnized on<\/p>\n<p>30.8.2004 and the de facto complainant left the matrimonial<\/p>\n<p>house within a few months on 1.4.2005. Since their efforts<\/p>\n<p>were taken to get back his wife and later O.P.No.651 of 2006<\/p>\n<p><span class=\"hidden_text\">     BA.5891\/08                    2<\/span><\/p>\n<p>was filed for restitution of conjugal rights. The de facto<\/p>\n<p>complainant failed to contest the matter and ex parte order<\/p>\n<p>was passed in favour of the petitioner. He again took effort to<\/p>\n<p>get back the wife, but she did not turn up and hence after two<\/p>\n<p>years, he filed O.P.No.153 of 2008 for divorce (vide Annexure-<\/p>\n<p>I) on 23.2.2008. But, after three months, the present complaint<\/p>\n<p>is lodged by the de facto complainant making false allegations,<\/p>\n<p>it is submitted.\n<\/p>\n<p>       3. Learned Public Prosecutor submitted that the<\/p>\n<p>allegations made in the complaint are serious in nature. But,<\/p>\n<p>admittedly, there is inordinate delay in lodging the complaint.<\/p>\n<p>Taking into consideration the circumstances, under which the<\/p>\n<p>complaint is lodged, I find that anticipatory bail can be granted<\/p>\n<p>and hence the following order is passed:\n<\/p>\n<blockquote><p>              Petitioner  shall   surrender     before    the<\/p>\n<p>       Magistrate Court within seven days from today<\/p>\n<p>       and if bail application is filed, he shall be released<\/p>\n<p>       on bail on his executing a bod for Rs.25,000\/- with<\/p>\n<p>       two solvent sureties each for the like sum to the<\/p>\n<p>       satisfaction of the learned Magistrate, on the<\/p>\n<p>       following conditions:<\/p>\n<blockquote><p><span class=\"hidden_text\">    BA.5891\/08                   3<\/span><\/p>\n<\/blockquote>\n<blockquote><p>              i)   Petitioner shall report before the<\/p>\n<p>                   investigating officer as and when<\/p>\n<p>                   directed.\n<\/p><\/blockquote>\n<blockquote><p>              ii)  Petitioner shall make himself available<\/p>\n<p>                   for interrogation by the investigating<\/p>\n<p>                   officer.\n<\/p><\/blockquote>\n<blockquote><p>              iii) Petitioner shall co-operate with the<\/p>\n<p>                   investigation.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>              iv) Petitioner shall not commit any offence<\/p>\n<p>                   while on bail<\/p>\n<p>     Petition is allowed.<\/p><\/blockquote>\n<p>                                   K.HEMA, JUDGE<br \/>\nvgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Saji Williams vs Sub Inspector Of Police on 23 September, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5891 of 2008() 1.
