KRISHNAN, J.\n                  ...........................................\n                   M.A.C.A.No.780 OF 2007\n                 .............................................\n            Dated this the 16th day of March, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against                    the   award of the<\/p>\n<p>Claims Tribunal, Muvattupuzha                 in     OP(MV)No.1285\/2003.<\/p>\n<p>The insurance company had challenged the award passed<\/p>\n<p>by the tribunal awarding the claimant a compensation of<\/p>\n<p>Rs.42,866\/=.   The contention of the insurance company as<\/p>\n<p>revealed from the award is to the effect that it was not the<\/p>\n<p>first respondent who was riding the vehicle, but it was the<\/p>\n<p>second respondent who was riding the vehicle. The tribunal<\/p>\n<p>considered Exts.A1 to A5 documents. The First Information<\/p>\n<p>Statement and registration of the crime revealed that, it is<\/p>\n<p>alleged that,  the first       respondent             has driven the    auto<\/p>\n<p>rickshaw.    The police        after due investigation             has only<\/p>\n<p>charge sheeted the first respondent.                     The tribunal further<\/p>\n<p>observed that Exts.A1 to A5 were marked on consent and<\/p>\n<p>therefore, it was futile on the part of the insurance company<\/p>\n<p>to contend otherwise. The investigation records point out<\/p>\n<p>that auto rickshaw was driven by the first respondent in the<\/p>\n<p><span class=\"hidden_text\">                             : 2 :<\/span><br \/>\nM.A.C.A.No.780 OF 2007<\/p>\n<p>OP(MV).\n<\/p>\n<p>      2. Mere suspicion raised by the insurance company<\/p>\n<p>shall not be a substitute for the proof.  The court cannot<\/p>\n<p>decide the matter on the basis of  conjectures and surmises<\/p>\n<p>and therefore, I do not find any valid ground to interfere<\/p>\n<p>with the decision rendered by the Claims Tribunal.<\/p>\n<p>     Therefore the appeal lacks merit and it is dismissed.<\/p>\n<p>                                  M.N.
