JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/05\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npresent petition has been preferred under Article 226 of the<br \/>\nConstitution of India with the following prayers:\n<\/p>\n<p> (a)\tTo<br \/>\nadmit this petition and to allow the same;\n<\/p>\n<p>(b)\tTo<br \/>\nquash and set aside impugned order dated 13-4-2010 passed by the<br \/>\nRespondent No.3 at Annexure-D in Daban Case No.15\/2009 and the<br \/>\nsubsequent notice dated 30-4-2010 at Annexure-E passed by the<br \/>\nrespondent no.3;\n<\/p>\n<p>(c)\tPending<br \/>\nthe admission, hearing and final disposal of this petition, be<br \/>\npleased to stay the execution, operation and implementation of the<br \/>\norder dated 13-4-2010 passed by the Respondent No.3 at Annexure-D in<br \/>\nDaban Case No.15\/2009 and the subsequent notice dated 30-4-2010 at<br \/>\nAnnexure-E passed by the respondent No.3 and further be pleased to<br \/>\nrestrain the respondents from taking any coercive action in pursuance<br \/>\nof the order and notice at Annexure-D and E respectively;\n<\/p>\n<p>(d)\tTo<br \/>\ngrant any other appropriate and just relief\/s;\n<\/p>\n<p>\tThe<br \/>\npetitioners were employees of Abad Dairy and were occupying<br \/>\nresidential quarters in the premises of Abad Dairy at the relevant<br \/>\npoint of time. Subsequently, the State Government took over Abad<br \/>\nDairy, by Resolution dated 03.07.2007, and the property vested in the<br \/>\nState Government, free from all encumbrances. The petitioners<br \/>\ncontinued to occupy quarters in the said premises. The City Mamlatdar<br \/>\n(respondent No.3) issued Notice dated 05.02.2009, under the<br \/>\nprovisions of Section 61 of the Bombay Land Revenue Code, 1879, to<br \/>\nthe petitioners, to which a reply was submitted by them. Ultimately,<br \/>\nproceedings under Section 61 were initiated and Notice dated<br \/>\n30.04.2010 under the provisions of Section 202 of the Bombay Land<br \/>\nRevenue Code came to be issued to the petitioners, for vacation of<br \/>\nthe premises, within a period of three days.\n<\/p>\n<p>\tI<br \/>\nhave heard Mr.B.C.Dave, learned advocate for the petitioners and<br \/>\nMr.P.K.Jani, learned Government Pleader for the respondents, perused<br \/>\nthe averments made in the petition, contents of the impugned Notice<br \/>\nand other documents on record.\n<\/p>\n<p>\tAfter<br \/>\narguing for some time, Mr.B.C.Dave,learned advocate for the<br \/>\npetitioners states, upon instructions, that each of the petitioners<br \/>\nshall give an Undertaking to the effect that they are residing in the<br \/>\nresidential quarters on the premises in question, along with their<br \/>\nfamilies, and shall vacate the said premises on, or before,<br \/>\n31.08.2010. It is further stated by the learned advocate for the<br \/>\npetitioners, that the petitioners shall undertake not to claim<br \/>\ntenancy or any other rights in the said premises. Such Undertakings<br \/>\nshall be filed by the  petitioners on, or before, 14.05.2010, in this<br \/>\nCourt, and in this view of the matter, no coercive measures be taken<br \/>\nby the State Government, upto 31.08.2010.\n<\/p>\n<p>\tThe<br \/>\nlearned Government Pleader submits that the protection granted to the<br \/>\npetitioners may be directed to come to an end if the Undertakings are<br \/>\nnot filed by the petitioners within the time stipulated, or the<br \/>\npremises are not vacated by 31.08.2010.\n<\/p>\n<p>\tIn<br \/>\nview of the above submissions, the following order is passed:\n<\/p>\n<p>\tEach<br \/>\nof the petitioners shall give separate Undertakings to the effect<br \/>\nthat they shall vacate the residential quarters where they are<br \/>\nresiding with their families, on, or before 31.08.2010. Further, they<br \/>\nshall not claim tenancy or any other rights, in respect of the said<br \/>\nresidential quarters, or seek extension of time for vacation of the<br \/>\npremises. The said Undertakings shall be filed before this Court, on<br \/>\nor before 14.05.2010. It is made clear that in the event that the<br \/>\nUndertakings are not filed on, or before, 14.05.2010, or, if filed,<br \/>\nthe petitioners do not vacate the quarters in question on, or before,<br \/>\n31.08.2010, the protection granted by this Court will come to an end<br \/>\nand the respondents will be at liberty to proceed with Notice dated<br \/>\n30.04.2010, and take action, in accordance with law. In the<br \/>\neventuality that the Undertakings are filed, as above, the<br \/>\npetitioners shall not be evicted upto 31.08.2010. This order will<br \/>\ncease to operate beyond the said date.
