RESPONDENT(S)\n\n\n\n\n                                 O R D E R\n<\/pre>\n<p>         Leave granted.\n<\/p>\n<p>         Learned        counsel        for        the        appellant        places<\/p>\n<p> reliance on the judgment of this Court in <a href=\"\/doc\/1161696\/\">Bhoop Ram v.<\/p>\n<p> State     of    U.P.,<\/a>       (1989)    3        SCC     1,    which     has     been<\/p>\n<p> consistently         followed        by     this        Court     in        various<\/p>\n<p> decisions rendered subsequently.<\/p>\n<p>         Our     attention       has        been       drawn     to     a     latest<\/p>\n<p> decision       of    this     Court       in     Vineet       Kumar        Gupta   @<\/p>\n<p> Dharminder v. State of Punjab, (Crl.A. No. 475\/2009),<\/p>\n<p> decided    on       6.3.2009,       wherein          the    accused        being   a<\/p>\n<p> juvenile       on    the     date     of       occurrence       had        attained<\/p>\n<p> majority and hence he was not sent to a Special Home.<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>         In the instant case, the appellant was 15= years<\/p>\n<p>of age on the date of commission of the offence and now<\/p>\n<p>he should be about 26-27 years of age.           In this view of<\/p>\n<p>the matter and also in view of the aforesaid judgment,<\/p>\n<p>the appellant cannot be sent to the Special Home now.<\/p>\n<p>         The conviction of the appellant is maintained<\/p>\n<p>but   his   sentence   is   reduced   to   the   period   already<\/p>\n<p>undergone by him.      We order accordingly.<\/p>\n<p>         The appellant is presently in the District Jail,<\/p>\n<p>Kurukshetra, Haryana.
