5   14.7.2008             Heard learned counsel for the appellant, learned counsel for the State<\/p>\n
                and learned counsel for the informant in respect of prayer of the appellant for<\/p>\n
                bail which has been renewed through IA No.1080 of 2008.<\/p>\n
                          It has been submitted that the earlier order dated 26.4.2007 would<\/p>\n
                show that the prosecution party had come to Darwaza of the accused and<\/p>\n
                allegedly this appellant gave a single Khanti blow on the head of the deceased.<\/p>\n
                It has further been submitted that several witnesses who are close relations of<\/p>\n
                the informant such as PWs 2, 3 did not attribute Khanti blow to this appellant<\/p>\n
                before the IO. It has further been submitted that a lady inmate of appellant’s<\/p>\n
                family was injured and for that a counter case was lodged in which the doctor’s<\/p>\n
                report was also filed to show that she had sustained injury on the head by hard<\/p>\n
                and blunt substance although the said injury was found to be simple.<\/p>\n
                          Considering all the facts and circumstances, the prayer of the<\/p>\n
                appellant for bail is allowed. During pendency of this appeal, let appellant,<\/p>\n
                Sunil Singh, be released on bail on furnishing bail bond of Rs.10000\/- with two<\/p>\n
                sureties of the like amount each to the satisfaction of the trial court i.e. Addl.<\/p>\n
                Sessions Judge, FTC No.V. Bhagalapur in Sessions Trial Case No.1212\/2004,<\/p>\n
