BASANT, J.\n\n              -------------------------------------------------\n\n                       B.A.NO.3809 OF  2007\n\n              -------------------------------------------------\n\n               Dated this the  26th day of June, 2007\n\n\n\n                                  ORDER\n<\/pre>\n<p>      Application   for   anticipatory   bail.       The   petitioner   faces<\/p>\n<p>allegations in a crime registered under Secs.409 and 420 of the<\/p>\n<p>IPC.       The  crime   has  been  registered   on  basis  of  a  complaint<\/p>\n<p>filed before the learned Magistrate  and  referred to the police<\/p>\n<p>under Sec.156(3) of the Cr.P.C.    The crux of the allegations is<\/p>\n<p>that the petitioner, who had collected the amounts as an agent<\/p>\n<p>of   a   Chitty   Company,   had   fraudulently   bid   the   chitty   without<\/p>\n<p>the knowledge, information or consent of the complainant and<\/p>\n<p>had appropriated such amounts without informing the de facto<\/p>\n<p>complainant for the purpose of the petitioner.   Investigation is<\/p>\n<p>in progress.  The petitioner apprehends imminent arrest.<\/p>\n<p>      2.       The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p>the   allegations   are   totally   unjustified.     All   the   amounts<\/p>\n<p>collected have been remitted to the Canara Bank as seen from<\/p>\n<p><span class=\"hidden_text\">B.A.NO.3809 OF  2007                    -: 2 :-<\/span><\/p>\n<p>the   statement   of   accounts   maintained   in   the   Bank.     The<\/p>\n<p>petitioner works as an agent of  the Canara Bank.<\/p>\n<p>       3.   The learned Public Prosecutor opposes the application.<\/p>\n<p>The   learned   Public   Prosecutor   submits   that   the   fact   that   the<\/p>\n<p>amounts have been remitted with the Canara Bank is no answer<\/p>\n<p>to the allegations raised against the petitioner.   The allegation is<\/p>\n<p>that   the   chitty   has   been   bid   without   the   knowledge   of   the   de<\/p>\n<p>facto complainant and the amount has been misappropriated.   I<\/p>\n<p>find merit in the  opposition of the learned Public Prosecutor.   I<\/p>\n<p>do not find any circumstances that would justify the invocation of<\/p>\n<p>the   extraordinary   equitable   discretion   under   Sec.438   of   the<\/p>\n<p>Cr.P.C.   in   favour   of   the   petitioner.         The   Case   Diary   has   been<\/p>\n<p>placed before me for my perusal.\n<\/p>\n<\/p>\n<p>       4.  In the result,  this Bail Application is dismissed; but with<\/p>\n<p>the   observation   that   if   the   petitioner   surrenders   before   the<\/p>\n<p>Investigators   or   the   learned   Magistrate   having   jurisdiction   and<\/p>\n<p>applies   for   bail,   after   giving   sufficient   prior   notice   to   the<\/p>\n<p><span class=\"hidden_text\">B.A.NO.3809 OF  2007                 -: 3 :-<\/span><\/p>\n<p>Prosecutor   in   charge   of   the   case,   the   learned   Magistrate   must<\/p>\n<p>proceed to pass appropriate orders on merits and expeditiously.<\/p>\n<p>                                                                 Sd\/-\n<\/p>\n<p>\n                                                    (R.
