Respondents\n                                   ----------------------------------\n<\/pre>\n<p>02\/   11.08.2011               Heard learned counsel for the petitioner<\/p>\n<p>                    and the State.\n<\/p>\n<p>                               2. During the pendency of the writ petition,<\/p>\n<p>                    petitioner superannuated while serving on the post of<\/p>\n<p>                    Gardener in the office of the Executive Engineer,<\/p>\n<p>                    Central Division, Building Construction Department,<\/p>\n<p>                    Patna. Earlier he had filed the writ petition praying,<\/p>\n<p>                    inter alia, to direct the State- respondents to consider<\/p>\n<p>                    his case for promotion on Class III post, as one<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>         Devendra Prasad Sinha, who is not included in the<\/p>\n<p>         Merit-cum- Seniority list, Annexure-2, was so<\/p>\n<p>         promoted.\n<\/p>\n<p>                     3. It is submitted on behalf of the petitioner<\/p>\n<p>         that aforesaid Devendra Prasad Sinha was junior to<\/p>\n<p>         the petitioner in Class IV Grade. It is, however, not<\/p>\n<p>         stated in the writ petition that aforesaid Devendra<\/p>\n<p>         Prasad Sinha         never passed the departmental<\/p>\n<p>         examination required for promotion on Class III post.<\/p>\n<p>                     4. This writ petition is, accordingly,<\/p>\n<p>         disposed of directing the petitioner to represent<\/p>\n<p>         before   the    competent    authority of     the   State<\/p>\n<p>         Government praying that his case should be<\/p>\n<p>         considered for grant of promotion on the grounds<\/p>\n<p>         stated in the writ petition. The representation filed in<\/p>\n<p>         compliance of this order be disposed of by the<\/p>\n<p>         competent authority of the State Government as early<\/p>\n<p>         as possible, in any case within two months from the<\/p>\n<p>         date of its receipt. In case petitioner is allowed<\/p>\n<p>         promotion, the same shall be given to him for the<\/p>\n<p>         period until he remained in service.\n<\/p>\n<\/p>\n<pre>Arjun\/                                       ( V.
