having iegard to the facts and circumstances.<\/p>\n
2. The petitioner in

\nGulbarga. It is contelndied’  Policy,
\n1986,  for teachers
\nthroughoul   of the constitutional
\n maintenance and co-\n<\/p>\n
ordinationiof   education and with a view to<\/p>\n
attract and reta_ihitale.nt in the teaching profession and in<\/p>\n
\u00bb :accordanceJWit_h the recommendations of the RC. Mehrothra<\/p>\n
 those of the UGC, the Central Government<\/p>\n
had revised the pay scales of the teachers in Universities and<\/p>\n
“ii .Cio’llteges, excluding the Agricultural Universities. And all the<\/p>\n
Hlcolleges were admitted to the privileges of the Universities.<\/p>\n

in this regard the Government of India extended<\/p>\n
\ufb01nancial assistance to such of the State governments’-.v_vl1o<\/p>\n
adopted and implemented the Scheme, subjecti.<\/p>\n

  is contended that the college of the petitioner<\/p>\n
 earlier affiliated to the Karnatak University ,is<\/p>\n
noiia\/..aift’1liated to the Gulbarga University. That the State<\/p>\n
 .Vg:ove1’nment had extended the revised scales of pay<\/p>\n
lgrecornmended by the UGC and accepted by the Government<\/p>\n
of India, to the teachers of tg colleges under the control of<\/p>\n
On several representations made to the State and<\/p>\n
Central Governments to extend the bene\ufb01t of UGC sc.a_1e.silto<\/p>\n
the law colleges, the UGC had requested’1—the:”i*.State’~—-if ~<\/p>\n
Government to implement the scales: ofpay recon\u00a7ic1ie4nded_jby’i’V, 1<\/p>\n
it to the staff of the law colleges”;—.<\/p>\n
It is contended tthatV_the Sitate. hadexcluded
\neight colleges from the  of pay scales,
\nwhich is   one of several
\nrepeated   lithe Government, an
\n as on 20-9-1995 to state that<\/p>\n
there wa”s,__noVvprovisiioiiiha extend the said bene\ufb01t to law<\/p>\n
  But “t”ne__I}’GC had by a letter dated 4-11-1995 ,<\/p>\n
‘ “that:.t’iie staff of law colleges were also included in<\/p>\n
itheflist _of”et:~liieges approved under the provisions of section<\/p>\n
 2(n of___the ooc Act,1956. But this was to no avail, as the<\/p>\n
  ‘Director of collegiate education continued to hold that the<\/p>\n
.–7proposa1 to extend the benefit was kept pending.<\/p>\n

in this background the petitioner had approached”-.this<\/p>\n
court by way of a writ petition in WP  <\/p>\n

directing the petitioners to  remedy
\nunder the Karnataka   Accordingly, an
\nappeal was \ufb01lediunder  ll of the said Act.

 itnie.._Diirector of Collegiate Education. Teachers of law<\/p>\n
lfcollleges were excluded from the bene\ufb01t of the revision.<\/p>\n

The petitioner therefore filed a writ petition in WP
\n31886\/2000, which came to be disposed of in
\nearlier decision of a division bench of this court  0.
\n3894 \/ 2000 dated 11-4-2001, whie:i1s\u00bbieVo1veeiiiei4ii

\n aid. In fact the State Government<\/p>\n
1  iiotfderty its obligation to sanction the<\/p>\n
grant. ‘But the only impediment seems to be<\/p>\n
*~ that the Central government has not<\/p>\n
released its share which is the major share.
\nIn these circumstances, we consider it just<\/p>\n
and proper to direct the State Goverriment to<\/p>\n

  be.late:d,and henee”‘*eoa1d not be granted. It was also stated<\/p>\n
l1.hatith’e..:Ai””tate:vllC:()vemment had been duly informed of this<\/p>\n
i)ositio:1’ais.i”on 24.01200} itself. The petitioner would hence<\/p>\n
 .. contend that the state government had not brought this<\/p>\n
 circumstance to the attention of this court either before the<\/p>\n
H learned single judge or the Division Bench on the earlier<\/p>\n
occasion. In any event the blame lies at the door of the State<\/p>\n

government as it had delayed sending the proposal for the<\/p>\n
payment of the UGC scale , to the Central G0V6lfHI}il\u20ac:rllt._V_,<\/p>\n
which was due from \u00a3986. To add to this even  .<\/p>\n
the revision of pay scales due from   ii<\/p>\n
government had not made any effort iobtain_,pisanctig,i.,\u00a3\u00a7f’i–.<\/p>\n
grant. It is in the wake of thesev-.cii’cumstancesathatitheiifirst of<\/p>\n
the writ petitions is \ufb01led.’~~.__<\/p>\n

0   Diireictor of Collegiate Education, to contend that the<\/p>\n
lecturevrsiiiwoirking _in Government First Grade Colleges,<\/p>\n
 pp ?$rivate_.ii:’Aided Degree Colleges and ?rivate aided Law<\/p>\n
ii “~s_iicoiieges were drawing the State pay scale of Rs. 1900-3650<\/p>\n
“till 3l.E2.i.985.The Government by its order dated<\/p>\n
30.03.1990 had revised the pay scales of lecturers granting<\/p>\n
