that  disclosed his correct date of birth<\/p>\n
was   that aspect.\n<\/p>\n
  3. V.’%\\%\u00a7’11ploycr did not act on the request for<\/p>\n
   and was pursumg\u00b0 the enquiry and in<\/p>\n
   _- “bile the date \ufb01mn which the petitioner had<\/p>\n
   for for being relieved from services on 31.5.2008 also<\/p>\n
   expired and therefore the petitioner cemtinued in<\/p>\n

service, subsequently the employer has in terms of “order<\/p>\n
dated 11.8.2008 [copy at Amwxure-F] has  <\/p>\n
petitioner to retire from service with effect   <\/p>\n
31st May, 2003.\n<\/p>\n
4. It is this order which is  foe writ” 0<\/p>\n
petition.\n<\/p>\n
5. Appearing     Dharigond,<\/p>\n
I learned counsel  the petitioner<\/p>\n
while    ‘hfe\ufb01iement with effect from
\n31.5.20()8v,V.7hes  to quash the order,<\/p>\n
particularly  when once the respondent —<\/p>\n
:.’j’employe\u00a3* did not  the request of the petitioner to<\/p>\n
 from service with effect from 31.5.2008<\/p>\n
 order subsequently gving e\ufb01ect to that<\/p>\n
 ateqaxest w:.t\u00a7; retrospective effect and further making it<\/p>\n
 sagbject is outcome of the enquiry that had been initiated<\/p>\n
  the petitioraer.\n<\/p>\n<\/p>\n

6. Submission is that if the employer wishes to <\/p>\n
the enquiry, the petitioner is not R0811 on presekig <\/p>\n
application for vokmtaiy retirement and.   –.  <\/p>\n

\nhis request that cannot be  toifjhevvfeutcome<\/p>\n
of the enquiry.<\/p>\n
