For the<br \/>\noffence punishable under Section 506(2) of the Indian Penal Code,<br \/>\nlearned Sessions Judge was pleased to sentence the appellant to<br \/>\nundergo R.I. for one year and to pay a fine of Rs.500\/-, in default,<br \/>\nto undergo further R.I. for one month.\n<\/p>\n<p>\tThe<br \/>\nbrief facts of the prosecution case is as under:\n<\/p>\n<p>2.\tAs<br \/>\nper the case of the prosecution, one Madhuben, wife of Natubhai<br \/>\nChandubhai Oza, resident of Bechraji lodged a complaint before<br \/>\nBecharaji Police Station alleging that the complainant lady on<br \/>\ntelephone message was told by the appellant   accused to keep<br \/>\nillicit relationship with him, and if having not done so, the<br \/>\nappellant accused threatened the lady to murder her husband. The<br \/>\nappellant caused mental torture to the complainant lady and<br \/>\ntherefore, complainant lady committed suicide by setting ablazed her<br \/>\nby stove of kerosene.  Therefore, the complaint being C.R. I NO.27 of<br \/>\n2001 was lodged before Becharaji Police Station for the offences<br \/>\npunishable under Sections 306, 517 and 506 of the Indian Penal Code<br \/>\nagainst the appellant.\n<\/p>\n<p>3.\tThereafter,<br \/>\nstatements of the witnesses were recorded, panchnama was drawn and<br \/>\naccused was arrested. There was sufficient evidence against the<br \/>\nappellant, charge-sheet was filed before the learned Chief Judicial<br \/>\nMagistrate First Class, Bechraji. Thereafter, as the case was<br \/>\nexclusively triable by the Court of Sessions, the learned Magistrate<br \/>\nhas committed the case to the Court of Sessions, which was numbered<br \/>\nas Sessions Case No.203 of 2005.\n<\/p>\n<p>4.\tThereafter,<br \/>\nthe charge was framed against the appellant. The appellant<br \/>\naccused has pleaded not guilty and claimed to be tried.\n<\/p>\n<p>5.<br \/>\nTo prove the case against the appellant, the prosecution has produced<br \/>\ndocumentary evidence and also examined the witnesses before the<br \/>\nSessions Court.\n<\/p>\n<p>6.\tThereafter,<br \/>\nafter examining the witnesses, further statement of the appellant<br \/>\naccused under Section 313 of the Code of Criminal Procedure was<br \/>\nrecorded in which the appellant   accused has denied the case of<br \/>\nthe prosecution.\n<\/p>\n<p>7.\tAfter<br \/>\nconsidering the oral as well as documentary evidence and after<br \/>\nhearing the parties, learned Principal Sessions Judge, Mehsana vide<br \/>\njudgment and order dated 10.4.2006 held the appellant   accused<br \/>\nguilty to the charge levelled against him as stated above.\n<\/p>\n<p>8.\tFeeling<br \/>\naggrieved and dissatisfied with the impugned judgment and order of<br \/>\nconviction and sentence passed by the learned Sessions Judge, the<br \/>\npresent appellant has preferred this appeal.\n<\/p>\n<p>9.\tLearned<br \/>\nadvocate Mr. Devang Dave, the Amicus curiae  appearing on behalf of<br \/>\nthe appellant submitted that there were several contradiction between<br \/>\nthe documentary evidence produced by the prosecution and they were<br \/>\nnever proved as per the Evidence Act, even though the learned<br \/>\nSessions Judge held guilty the appellant for the offence alleged and<br \/>\nconvicted the appellant. Therefore, the order impugned is required to<br \/>\nbe quashed and set aside by allowing the appeal.\n<\/p>\n<p>10.\tLearned<br \/>\nadvocate Mr. Dave for the appellant argued that he is not arguing<br \/>\nthis matter on merits, but arguing only on the quantum of punishment<br \/>\nso far it relates to the sentence imposed by the learned trial Judge<br \/>\nand the appellant accused has already undergone the period of more<br \/>\nthan 4 years out of total imprisonment. Therefore, he argued that<br \/>\nconsidering the period which undergone by the appellant accused in<br \/>\njail may be considered as sentence, as he has undergone more than<br \/>\nhalf period of total sentence.\n<\/p>\n<p>11.\tThe<br \/>\nlearned APP Mr. H.H. Parikh for the State strongly opposed the<br \/>\nsubmissions made by the learned advocate for the appellant. It<br \/>\nwas contended<br \/>\nby learned APP that the judgment and order of the Sessions Court is<br \/>\njust and proper and as per the provisions of law; the Sessions Court<br \/>\nhas properly considered the evidence led by the prosecution and<br \/>\nlooking to the provisions of law itself it is established that the<br \/>\nprosecution has proved the whole ingredients of the evidence against<br \/>\nthe present appellant. Learned APP has also taken this Court  through<br \/>\nthe oral as well  as the entire documentary evidence. He lastly<br \/>\nsubmitted that the appellant has undergone more than half period in<br \/>\njail and therefore, if the undergone period may be treated as<br \/>\nsentence, the State has no objection.\n<\/p>\n<p>12.\tI<br \/>\nhave perused the records and considered the submissions made by both<br \/>\nthe sides. I have also perused the judgment and order passed by the<br \/>\nlearned Sessions Judge. From the perusal of the judgment and order, I<br \/>\nam of the view that learned trial Judge has rightly observed the<br \/>\nevidence and also rightly sentenced the appellant. I am in total<br \/>\nagreement with the findings assigned by the learned Sessions Judge.<br \/>\nBut so far as the quantum of punishment is concerned, I have<br \/>\nconsidered the submission made by the learned advocate for the<br \/>\nappellant. The appellant is in jail from 1.4.2006 and therefore,<br \/>\nlooking to the quantum of punishment, the sentence imposed by the<br \/>\nlearned Sessions Judge is required to be modified and the period,<br \/>\nwhich has already been undergone by the appellant is required to be<br \/>\ntreated as sentence.\n<\/p>\n<p>13.\tIn view<br \/>\nof the above observation, the<br \/>\nAppeal is partly allowed. the\tAppeal<br \/>\nis partly allowed. The<br \/>\njudgment and order dated 10.4.2006 passed by the learned Principal<br \/>\nSessions Judge, Mehsana in Sessions Case No.203 of 2005, is hereby<br \/>\nmodified and it is hereby ordered that the appellant&#8217;s undergone<br \/>\nsentence, shall be treated as sentence. The appellant is ordered<br \/>\nto be set at liberty forthwith, if not required in any other case.<br \/>\nRest of the judgment of the learned Sessions Court shall remain<br \/>\nunaltered.
