Justice K.HEMA\n\n Dated :03\/03\/2008\n\n O R D E R\n                      J.B.KOSHY &amp; K.HEMA, JJ.\n                       --------------------------------------\n                        M.F.A.No.126 OF 2007\n                       -------------------------------------\n                         Dated 3rd March, 2008\n\n                                JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>           Appellant was the auction purchaser of five cents of property<\/p>\n<p>with a building from the Official Receiver.               He paid 1\/4th of the sale<\/p>\n<p>price.  Balance was not paid.         Since balance was not paid, Official<\/p>\n<p>Receiver decided to re-auction the building and auction is going to be<\/p>\n<p>conducted tomorrow. According to the appellant, auction should not be<\/p>\n<p>conducted and he did not pay the balance amount in time due to<\/p>\n<p>unavoidable circumstances. It is submitted by the Official Receiver that<\/p>\n<p>all arrangements are made for conducting re-auction tomorrow and it<\/p>\n<p>should not be disturbed. It is also submitted that Official Receiver is<\/p>\n<p>prepared to refund the amount paid by the appellant after deducting the<\/p>\n<p>expenses incurred by him for publishing notice etc. for re-auction.<\/p>\n<p>Learned counsel for the appellant submitted that he is also agreeable for<\/p>\n<p>the above. In the above circumstances, we dispose of this appeal with a<\/p>\n<p>direction that the amount paid by the appellant shall be refunded after<\/p>\n<p>deducting the expenses already incurred by the Official Receiver in<\/p>\n<p><span class=\"hidden_text\">MFA.126\/2007                      2<\/span><\/p>\n<p>conducting re-auction.
