       Petition for anticipatory bail.\n<\/p>\n
       2. The alleged offences are under sections 143, 147, 148,<\/p>\n
149, 341, 294(b), 323, 324, 326 and 427 read with section 149<\/p>\n
IPC.    According to prosecution, on 15-12-2008 at about 10.30<\/p>\n
p.m. petitioners (A1 to A4) along with other accused formed<\/p>\n
themselves into an unlawful assembly armed with deadly<\/p>\n
weapons committed rioting and wrongfully restrained de facto<\/p>\n
complainant, abused him in filthy language, attacked him by<\/p>\n
beating with hands and also with cricket bat and inflicted<\/p>\n
injuries, including fracture to the leg.\n<\/p>\n
       3. Learned counsel for petitioners submitted that<\/p>\n
petitioners are brothers who are aged 21 to 29 years. The 1st<\/p>\n
accused is a literature student, 2nd accused is a Marking<\/p>\n
Executive in Bangalore, 3rd accused is a Plus Two student and<\/p>\n
4th accused is a glass merchant. Their father died 23 years ago<\/p>\n
and their mother was residing in the house, which was allotted<\/p>\n
to them by grandfather. Father’s brother was attempting to evict<\/p>\n
the mother and family members illegally and on 15-2-2008 when<\/p>\n
the mother was alone in the house, after a bypass surgery taking<\/p>\n
rest, father’s brother who is de facto complainant went to the<\/p>\n

house with gundas and assaulted her and also molested her and<\/p>\n
attempted to evict her forcibly from the house and in respect of<\/p>\n
the incident a complaint was given to the police.<\/p>\n
      4. According to      petitioners, the gundas who were<\/p>\n
employed by de facto complainant could not carry out the work<\/p>\n
entrusted to them and hence they were not given money, as<\/p>\n
promised by the de facto complainant. Therefore, they assaulted<\/p>\n
de facto complainant and broke his leg on the same night. On<\/p>\n
16-12-2008 and 17-12-2008, again, attempts were made by de<\/p>\n
facto complainant to unlawfully evict petitioners and the mother<\/p>\n
from the property. Criminal complaints were filed and crime was<\/p>\n
registered and one of the accused in those crimes is a notorious<\/p>\n
gunda by name “Kuppichil Ani”.\n<\/p>\n
      5. It is also submitted that de facto complainant is in the<\/p>\n
habit of creating false evidence by manipulating and distorting<\/p>\n
facts and in order to establish that de facto complainant is in<\/p>\n
possession of the property, he even filed a writ petition for police<\/p>\n
protection, contending that de facto complainant is in possession<\/p>\n
of the disputed house. The said application was disposed of, on<\/p>\n
being convinced that petitioners are in possession. Similarly de<\/p>\n
facto complainant has filed this false complaint also by misusing<\/p>\n
the injuries sustained by him at the hands of gundas. This is<\/p>\n

done with a view to harass petitioners and also to see that in<\/p>\n
their absence, their mother could be evicted from the house<\/p>\n
illegally. If anticipatory bail is refused, it will result in<\/p>\n
irreparable loss and injury and hence, anticipatory bail may be<\/p>\n
granted, it is submitted.\n<\/p>\n
       6. Learned counsel for petitioners also submitted that<\/p>\n
petitioners are prepared to surrender before the Investigating<\/p>\n
Officer and co-operate with the investigation. Petitioners are<\/p>\n
innocent of the allegations made.\n<\/p>\n
        7. Learned Public Prosecutor submitted that petitioners<\/p>\n
are required for recovery of weapons used and also for<\/p>\n
interrogation. De facto complainant sustained grievous hurt and<\/p>\n
communited fracture on the leg and he was hospitalized in<\/p>\n
Kerala Institute of Medical Sciences, Anamukham.<\/p>\n
       8. On hearing both sides, on going through the case diary<\/p>\n
and wound certificate     in which many relevant facts such as<\/p>\n
alleged cause of injuries etc. are absent , and the fact that as per<\/p>\n
the said wound certificate, the admission to hospital is only on<\/p>\n
the next day of incident, and on appreciation of various facts<\/p>\n
and circumstances of the case, I am of the view that if<\/p>\n
anticipatory bail is refused, it will result in miscarriage of justice,<\/p>\n
since petitioners appear to have a strong defence to put forward,<\/p>\n

which can be established only during trial.<\/p>\n
      8. Hence, the following order is passed:-\n<\/p>\n
      (1)     Petitioners   shall  surrender   before   the<\/p>\n
           Magistrate Court concerned within seven days<\/p>\n
           from today and they shall be released on bail,<\/p>\n
           on their executing a bond for Rs. 25,000\/- each<\/p>\n
           with two solvent sureties each, for the like<\/p>\n
           amount, to the satisfaction of the learned<\/p>\n
           Magistrate, on the following conditions:-<\/p>\n
           i)    Petitioners shall   report before the\n\n                 Investigating Officer within four days\n\n                 from the date of release on bail and co-\n\n                 operate with the investigation.\n\n           ii)   Petitioners shall not intimidate or\n\n                 influence any witness or tamper with\n\n                 evidence or commit any offence while\n\n                 on bail.\n\n      This petition is allowed.\n\n                                           K.HEMA, JUDGE.\n\nmn.\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"
