The petitioner also  challenged\nthe  provisions\t of  the Punjab Jail  Manual  which  creates\nartificial   discrimination  between  Indian  and   European\nprisoners   in\tthe  matter  of\t treatment  and\t diet.\t The\nrespondent  contended  that since the  petitioner  has\tbeen\nreleased   the\t petition  has\tbecome\t infructuous.\t The\npetitioner  cited various authorities of this Court as\twell\nas  of the Supreme Court of United States that where  issues\nof  great  moment  affecting  liberty  of  the\tcitizen\t are\ninvolved the decision should not be avoided even though\t the\nimmediate  prohibition' which led to the filing of the\twrit\npetition has for the time being disappeared.\nHELD : The Court would not decide the issue for two reasons.\nFirstly,  the  petitioner  is  no  longer  in  prison,\tand,\nsecondly,  the\tLeamed Solicitor General assured  the  Court\nthat he would draw attention of the Punjab Government to the\nneed  for revision of the impugned rules from the  point  of\nview  of  racial equality.  The court hoped that  the  State\nGovernment  would take up the reform of the  law,  eluminate\nthe  vice of inequality and update the regulations to be  in\nkeeping\t with  the spirit and letter of the  paramount\tlaw.\n[583D-E]\nPetition dismissed.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORIGINAL JURISDICTION : Writ Petition No. 318 of 1970.<br \/>\nPetition under Article 32 of the Constitution of India.<br \/>\nSantok Singh, for the Petitioner.\n<\/p>\n<p>L.  N. Sinha and R. N. Sachthey, for Respondents Nos. 1 &amp; 3.<br \/>\nThe Judgment of the Court was delivered by :<br \/>\nKRISHNA IYER, J.-Shri Madhu Limaya, M.P. moved this petition<br \/>\nwhile  he was prisoner, imbued more by the pro bono  publico<br \/>\nsphit  than perhaps by his own invidious lot in\t jail.\t The<br \/>\ngravamen  of  this public grievance in that  a\tlong  silver<br \/>\njubilee\t span of years. having elapsed after India became  a<br \/>\nSovereign  Democratic Republic. it is obnoxious that  racial<br \/>\ndiscrimination,\t  smacking  of\tcolonial  hangover,   should<br \/>\nstubbornly  resist  arts. 14 &amp; 15 of  the  Constitution\t and<br \/>\nsurvive in the Punjab Jail Manual.  If it were so, it were a<br \/>\nmatter to blush for, but the preliminary objection raised by<br \/>\nthe  Solicitor\tGeneral is that the petitioner\thaving\tbeen<br \/>\nfreed  from  prison  years ago, this  Court  should  not  be<br \/>\ninvited into an academic exercise on a constitutional issue.<br \/>\nof  course,  he concedes that the Court is not\tdeprived  of<br \/>\njurisdiction by the cessation of incarceration.\t An inflexi-<br \/>\nble  rule  that as soon as a custodial term  or\t prohibitory<br \/>\norder  expires the Court will not investigate  its  legality<br \/>\nmay  well  immunize ephemeral  illegality  against  judicial<br \/>\nreview\ton  unwitting  infraction of the  amplitude  of\t the<br \/>\nCourt&#8217;s powers.\t But there are cases and cases.\n<\/p>\n<p><span class=\"hidden_text\">583<\/span><\/p>\n<p>Mr.  Santok  Singh, for the petitioner, has brought  to\t Our<br \/>\nnotice\tdecisions of this Court and of the Supreme Court  of<br \/>\nthe  United  States to press home his point that  issues  of<br \/>\nsuch  great  moment affecting the liberty  of  the  citizens<br \/>\nshould not be avoided even though the immediate\t prohibition<br \/>\nwhich has led to the&#8217; writ petition has, or the time  being,<br \/>\ndisappeared  (See  Carroll  v.\tCommissioners  of   Princess<br \/>\nAnne(1) and United States v. Phosphate Export Asso(2);\talso<br \/>\n<a href=\"\/doc\/446363\/\">Madhu  Limaye  V.   Ved Murti<\/a>(s) and Himat Lal\tK.  Such  v.<br \/>\nCommr. of,-Police, Ahmedabad(4).\n<\/p>\n<p>The thrust of the charge of unconstitutionality made  bv.Sri<br \/>\nMadhu  Limaye  consists\t in  the  artificial  discrimination<br \/>\nbetween\t Indian\t and  European prisoners in  the  matter  of<br \/>\ntreatment and diet, going by the rules he has set out in his<br \/>\npetition. it is true that many laws which do not square with<br \/>\nthe  equality  enshrined in Arts. 14 and 15 die\t hard  until<br \/>\npronounced  dead by the &#8216;Court Prima facie the rules  quoted<br \/>\nare neither fair on their face nor equal in their bosom,  as<br \/>\nbetween.  Indians and Europeans., This white-complex has  no<br \/>\nright  to remain extent in the rules, according\t to  counsel<br \/>\nfor  the  petitioner.  We have drawn the  attention  of\t the<br \/>\nSolicitor  General  to what appears to be  an  obsolete\t but<br \/>\noverlooked  discrimination.  We are not inclined to  examine<br \/>\nthis matter more incisively for two reasons.  The petitioner<br \/>\nis  &#8216;no longer in prison.  Even so may-be the matter can  be<br \/>\ncompetently  scrutinized  from the constitutional  angle  by<br \/>\nthis  Court.  But the learned Solicitor General\t assures  us<br \/>\nthat he will draw the &#8216;attention of the Punjab Government to<br \/>\nthe  need for revision of the impugned rules from the  point<br \/>\nof view of racial equality.  In the light of this submission<br \/>\nwe hope the State Government will take up the reform of\t the<br \/>\nlaw, lop off dead wood, eliminate the vice of inequality and<br \/>\nupdate the regulations to be in keeping with the spirit\t and<br \/>\nletter of the paramount law.\n<\/p>\n<p>In- view of this attitude of the Solicitor General,  counsel<br \/>\nfor  tile petitioner himself expressed that he was not\tkeen<br \/>\non  going  on  with  the  case.\t  We  hope  that  the  above<br \/>\nobservations  would be sufficient for the high\tpurpose\t the<br \/>\npetitioner has in view.\n<\/p>\n<p>We. accordingly dismiss the petition.\n<\/p>\n<p>P.H.P.\t\tPetition dismissed.\n<\/p>\n<p>(1)  21 L.
