{"id":65189,"date":"2011-03-28T00:00:00","date_gmt":"2011-03-27T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/ajijun-nesha-vs-the-state-of-bihar-amp-ors-on-28-march-2011"},"modified":"2019-03-31T22:05:21","modified_gmt":"2019-03-31T16:35:21","slug":"ajijun-nesha-vs-the-state-of-bihar-amp-ors-on-28-march-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/ajijun-nesha-vs-the-state-of-bihar-amp-ors-on-28-march-2011","title":{"rendered":"Ajijun Nesha vs The State Of Bihar &amp;Amp; Ors on 28 March, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Ajijun Nesha vs The State Of Bihar &amp;Amp; Ors on 28 March, 2011<\/div>\n<pre>                            IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                      CWJC No.4997 of 2011\n                                          AJIJUN NESHA .\n                                             Versus\n                                    THE STATE OF BIHAR &amp; ORS .\n                                          -----------\n<\/pre>\n<p>2.   28.03.2011          Heard learned Counsel for the petitioner and the learned<\/p>\n<p>                  Counsel for the State.\n<\/p>\n<p>                         The petitioner seeks inclusion of her name in the voters list of<\/p>\n<p>                  Village Sundarpur under Gram Panchayat Raj Pachrukha (East) P.S. &amp;<\/p>\n<p>                  Anchal Banjaria, District East Champaran so as to enable her not only<\/p>\n<p>                  to caste her vote in the ensuing Panchayat election but also file<\/p>\n<p>                  nominations for the post of Mukhiya.\n<\/p>\n<p>                         Learned Counsel for the petitioner submits that when her name<\/p>\n<p>                  was left out from the voters list she petitioned the Booth Level Officer<\/p>\n<p>                  who on 25.2.2010 submitted a list of persons whose names had been<\/p>\n<p>                  left out in which her name figured at serial 16.This was given to the<\/p>\n<p>                  BDO cum Assistant Election Registration Officer on 20.7.2010. A fresh<\/p>\n<p>                  list was submitted by the Block Level Officer on 3.1.2011 to the BDO<\/p>\n<p>                  cum Assistant Election Registration officer in which her name again<\/p>\n<p>                  figured at serial 40. The petitioner states that she was asked by the<\/p>\n<p>                  BDO cum Assistant Election Registration Officer to appear before him<\/p>\n<p>                  on 4.3.2010 which she did notwithstanding all of which her name was<\/p>\n<p>                  not added.\n<\/p>\n<p>                         The lack of jurisdiction in the Court to grant any relief to the<\/p>\n<p>                  petitioner after the Panchayat elections have been notified and the<\/p>\n<p>                  electoral role have achieved finality have been noticed in the order of<\/p>\n<p>                  this Court in CWJC No. 4723 of 2011 disposed off by this Court on<\/p>\n<p>                  25.3.2011 in light of the order of a Division Bench of this Court reported<\/p>\n<p>                  in 2001 (3) PLJR 677.\n<\/p>\n<p>                    That however shall not close the issue with regard to the<\/p>\n<p>            allegations of dereliction in duty by those responsible for necessary<\/p>\n<p>            corrective action by the officials, if what the petitioner contends on facts<\/p>\n<p>            be correct.\n<\/p>\n<p>                   The District Magistrate, East Champaran is directed to hold an<\/p>\n<p>            enquiry by himself after notice to the petitioner and the BLO\/BDO. He<\/p>\n<p>            shall call for the original orders of the matter and then arrive at a finding<\/p>\n<p>            of fact. If he concludes that there was any dereliction duty on the part of<\/p>\n<p>            the government officials concerned, it is expected that he shall consider<\/p>\n<p>            ordering appropriate departmental action against the concerned so that<\/p>\n<p>            in future the citizens are not denied right to franchise merely because of<\/p>\n<p>            dereliction of duty by those in whom the Government vested powers in<\/p>\n<p>            trust to be used and not abused.\n<\/p>\n<p>                   Let such compliance by the District Magistrate be done by a<\/p>\n<p>            reasoned and speaking order in accordance with law within a maximum<\/p>\n<p>            period of four months from the date of receipt and or presentation of a<\/p>\n<p>            copy of this order before him.\n<\/p>\n<p>                   The writ application stands dismissed with the aforesaid<\/p>\n<p>            directions.\n<\/p>\n<\/p>\n<pre>Snkumar\/-                                    (Navin Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ajijun Nesha vs The State Of Bihar &amp;Amp; Ors on 28 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.4997 of 2011 AJIJUN NESHA .
