Justice B.P.RAY\n\n Dated :29\/11\/2010\n\n O R D E R\n   C.N.RAMACHANDRAN NAIR &amp; BHABANI PRASAD RAY, JJ.\n            ----------------------------------\n                       W.A.No.1953 of 2010\n             ---------------------------------\n           Dated, this the 29th day of November, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      This Writ Appeal is filed against the judgment of the learned<\/p>\n<p>Single Judge setting aside the detention order issued by the District<\/p>\n<p>Collector, with a direction to the District Collector to reconsider the<\/p>\n<p>matter.\n<\/p>\n<p>      2.   When the matter came up for admission, the Division<\/p>\n<p>Bench directed the learned Government Pleader to get instructions<\/p>\n<p>from the District Collector. It is now reported that the vehicle was<\/p>\n<p>carrying sand with a valid pass. The detention was at 3.00 pm,<\/p>\n<p>whereas the pass was valid till 4 pm. In the circumstances, this Writ<\/p>\n<p>Appeal has to be allowed by vacating that part of the judgment of<\/p>\n<p>the learned Single Judge remanding the matter to the District<\/p>\n<p>Collector for reconsideration.\n<\/p>\n<p>      Therefore, this Writ Appeal is allowed in part confirming the<\/p>\n<p>judgment of the learned Single Judge cancelling the impugned<\/p>\n<p>order, with a direction to the respondents to release the vehicle with<\/p>\n<p>W.A.No.1953\/2010<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>the load of sand unconditionally to the petitioner in the writ<\/p>\n<p>petition.\n<\/p>\n<p>      This Writ Appeal is allowed in part.\n<\/p>\n<\/p>\n<p>                             (C.N.RAMACHANDRAN NAIR, JUDGE)<\/p>\n<p>                             (BHABANI PRASAD RAY, JUDGE)<\/p>\n<p>jg<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Mujeeb Rahman vs The District Collector on 29 November, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WA.No. 1953 of 2010() 1.
