2.      We\u00a0heard\u00a0this\u00a0case\u00a0through\u00a0video\u00a0conferencing.\u00a0The\u00a0Respondent\u00a0was\u00a0<\/p>\n
not\u00a0present\u00a0in\u00a0the\u00a0Madhubani\u00a0studio\u00a0of\u00a0the\u00a0NIC\u00a0in\u00a0spite\u00a0of\u00a0notice.\u00a0<\/p>\n
3.      In \u00a0 our \u00a0 order \u00a0 dated \u00a0 16 \u00a0 October \u00a0 2009, \u00a0 we \u00a0 had \u00a0 directed \u00a0 the \u00a0 CPIO\u00a0<\/p>\n
concerned\u00a0to\u00a0provide\u00a0the\u00a0information\u00a0to\u00a0the\u00a0complainant\u00a0and\u00a0also\u00a0to\u00a0explain\u00a0to\u00a0<\/p>\n
us\u00a0if\u00a0he\u00a0had\u00a0a\u00a0reasonable\u00a0cause\u00a0for\u00a0the\u00a0delay\u00a0in\u00a0supplying\u00a0the\u00a0information.\u00a0<\/p>\n
Today,\u00a0during\u00a0the\u00a0hearing,\u00a0the\u00a0officer\u00a0concerned\u00a0appeared\u00a0and\u00a0submitted\u00a0that\u00a0<\/p>\n
the\u00a0Branch\u00a0Manager\u00a0who\u00a0had\u00a0received\u00a0the\u00a0RTI\u00a0application\u00a0in\u00a0the\u00a0first\u00a0place\u00a0had\u00a0<\/p>\n

\n responded\u00a0to\u00a0the\u00a0complainant\u00a0on\u00a019\u00a0December\u00a02008\u00a0and\u00a0had\u00a0provided\u00a0some\u00a0of\u00a0<\/p>\n
the\u00a0information.\u00a0In\u00a0his\u00a0written\u00a0submissions,\u00a0he\u00a0has\u00a0pleaded\u00a0that\u00a0the\u00a0delay\u00a0at\u00a0the\u00a0<\/p>\n
Branch \u00a0 level \u00a0 was \u00a0 not \u00a0 deliberate \u00a0 and \u00a0 was \u00a0 caused \u00a0 because \u00a0 the \u00a0 desired\u00a0<\/p>\n
information\u00a0was\u00a0vast\u00a0in\u00a0scope\u00a0and\u00a0took\u00a0time\u00a0for\u00a0collection.<\/p>\n
4.      We\u00a0carefully\u00a0considered\u00a0the\u00a0facts\u00a0of\u00a0the\u00a0case\u00a0including\u00a0the\u00a0submissions\u00a0<\/p>\n
made\u00a0by\u00a0the\u00a0then\u00a0Branch\u00a0Manager.\u00a0In\u00a0his\u00a0reply\u00a0dated\u00a019\u00a0December\u00a02008,\u00a0the\u00a0<\/p>\n
Branch\u00a0Manager\u00a0had\u00a0covered\u00a0all\u00a0the\u00a0queries\u00a0but\u00a0had\u00a0provided\u00a0the\u00a0information\u00a0<\/p>\n
against\u00a0 only\u00a0 a \u00a0 few \u00a0 of \u00a0 the \u00a0 queries,\u00a0 declining\u00a0 the \u00a0 rest \u00a0 with \u00a0 one \u00a0 or \u00a0 the \u00a0 other\u00a0<\/p>\n
explanation.\u00a0Thus,\u00a0in\u00a0effect,\u00a0not\u00a0much\u00a0information\u00a0had\u00a0been\u00a0disclosed.\u00a0Almost\u00a0<\/p>\n
all\u00a0the\u00a0information\u00a0sought\u00a0by\u00a0the\u00a0complainant\u00a0relates\u00a0to\u00a0the\u00a0loans\u00a0sanctioned\u00a0<\/p>\n
under \u00a0 the \u00a0 KCC \u00a0 scheme. \u00a0 Since \u00a0 under \u00a0 the \u00a0 scheme, \u00a0 some \u00a0 interest \u00a0 rate\u00a0<\/p>\n
concession\/subvention\u00a0is\u00a0offered\u00a0by\u00a0the\u00a0Bank,\u00a0in\u00a0line\u00a0with\u00a0our\u00a0past\u00a0decisions\u00a0in\u00a0<\/p>\n
such\u00a0matters,\u00a0some\u00a0details\u00a0about\u00a0these\u00a0loan\u00a0accounts\u00a0should\u00a0 be\u00a0 disclosed.\u00a0<\/p>\n
Therefore, \u00a0 we \u00a0 direct \u00a0 the \u00a0 CPIO \u00a0 to \u00a0 disclose \u00a0 the \u00a0 following \u00a0 information \u00a0 to \u00a0 the\u00a0<\/p>\n
complainant\u00a0within\u00a010\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order:<\/p>\n
        i) \u00a0 the \u00a0 list \u00a0 of \u00a0 borrowers\u00a0 from\u00a0 the \u00a0 Jhanjharpur\u00a0 Branch \u00a0 under\u00a0 the \u00a0 KCC\u00a0<\/p>\n
        scheme\u00a0during\u00a0the\u00a0years\u00a02006\u00ad07\u00a0and\u00a02007\u00ad08\u00a0including\u00a0the\u00a0amount\u00a0of\u00a0<\/p>\n
        loan\u00a0sanctioned\u00a0 in\u00a0 each\u00a0 case\u00a0 and\u00a0 the\u00a0 extent\u00a0 of\u00a0 land\u00a0 holding\u00a0 against\u00a0<\/p>\n
        which\u00a0the\u00a0loan\u00a0has\u00a0been\u00a0sanctioned;\n<\/p><\/blockquote>\n
<\/blockquote>\n
        ii) \u00a0 the \u00a0 photocopy \u00a0 of \u00a0 the \u00a0 government\/Bank \u00a0 guidelines, \u00a0 if \u00a0 any, \u00a0 on \u00a0 this\u00a0<\/p>\n
        particular\u00a0scheme\u00a0as\u00a0well\u00a0as\u00a0on\u00a0educational\u00a0loan;<\/p><\/blockquote>\n
        iii)\u00a0the\u00a0list\u00a0of\u00a0borrowers\u00a0whose\u00a0loans\u00a0had\u00a0been\u00a0waived\u00a0under\u00a0the\u00a0loan\u00a0<\/p>\n
        waiver\u00a0scheme\u00a0of\u00a0the\u00a0government\u00a0including\u00a0the\u00a0amount\u00a0of\u00a0loan\u00a0waived\u00a0in\u00a0<\/p>\n

\n         each\u00a0case;\n<\/p>\n<\/p>\n
        iv)\u00a0the\u00a0photocopy\u00a0of\u00a0any\u00a0loan\u00a0scheme(s),\u00a0if\u00a0any,\u00a0targeted\u00a0to\u00a0small\u00a0and\u00a0<\/p>\n
        marginal\u00a0farmers.\n<\/p>\n<\/p>\n
5.      No \u00a0 information\u00a0 need\u00a0 be\u00a0 given\u00a0 about\u00a0 the \u00a0 remaining\u00a0 queries\u00a0 as\u00a0 those\u00a0<\/p>\n
relate\u00a0to\u00a0information\u00a0in\u00a0the\u00a0nature\u00a0of\u00a0commercial\u00a0confidence\u00a0which\u00a0Section\u00a08(1)\u00a0<\/p>\n
(d)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act\u00a0exempts\u00a0from\u00a0disclosure.<\/p>\n
6.      While\u00a0accepting\u00a0the\u00a0explanation\u00a0of\u00a0the\u00a0then\u00a0Branch\u00a0Manager\u00a0regarding\u00a0<\/p>\n
the\u00a0delay\u00a0as\u00a0reasonable\u00a0in\u00a0the\u00a0light\u00a0of\u00a0the\u00a0variety\u00a0and\u00a0volume\u00a0of\u00a0information\u00a0<\/p>\n
sought, \u00a0 we \u00a0 are \u00a0 constrained \u00a0 to \u00a0 accept \u00a0 the \u00a0 demand \u00a0 of \u00a0 the \u00a0 complainant \u00a0 for\u00a0<\/p>\n
payment\u00a0of\u00a0compensation.\u00a0It\u00a0is\u00a0obvious\u00a0that\u00a0if\u00a0the\u00a0desired\u00a0information\u00a0had\u00a0been\u00a0<\/p>\n
given\u00a0earlier,\u00a0there\u00a0would\u00a0have\u00a0been\u00a0no\u00a0need\u00a0for\u00a0the\u00a0complainant\u00a0to\u00a0approach\u00a0<\/p>\n
the\u00a0CIC.\u00a0In\u00a0the\u00a0process,\u00a0it\u00a0is\u00a0clear\u00a0that\u00a0he\u00a0has\u00a0suffered\u00a0some\u00a0detriment\u00a0and\u00a0<\/p>\n
financial\u00a0loss.\u00a0He\u00a0deserves\u00a0to\u00a0be\u00a0compensated\u00a0for\u00a0this.\u00a0Therefore,\u00a0in\u00a0exercise\u00a0of\u00a0<\/p>\n
the\u00a0powers\u00a0vested\u00a0in\u00a0the\u00a0CIC\u00a0in\u00a0Section\u00a019\u00a0(8)\u00a0(b)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0<\/p>\n
(RTI)\u00a0Act,\u00a0we\u00a0direct\u00a0the\u00a0Bank\u00a0to\u00a0compensate\u00a0the\u00a0complainant\u00a0by\u00a0an\u00a0amount\u00a0of\u00a0<\/p>\n
Rs\u00a02000.\u00a0We\u00a0direct\u00a0the\u00a0CPIO\u00a0to\u00a0remit\u00a0this\u00a0amount\u00a0to\u00a0the\u00a0complainant\u00a0within\u00a015\u00a0<\/p>\n
working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order\u00a0by\u00a0way\u00a0of\u00a0a\u00a0demand\u00a0draft.<\/p>\n
7.      The\u00a0cases\u00a0disposed\u00a0of\u00a0accordingly.\n<\/p>\n
