Karnataka Sales Tax Act, 19571\u00b0'(\u00ab1q\u00e9t%\u00a2ii1aftc;;f’reier:~\u00e9\u00a7e,to~.,,<\/p>\n
as ‘the Act’).\n<\/p>\n
2. Revision   the order
\ndated 17.01.2008 pagseajinn’V.S\u00a7mni”‘;q\u00a7,p%les\/2006 by the
\nKarnataka   whereunder,
\nthe App_ellate:”  aside, a suo motu
\nrevisio;ial–_  been passed by the Joint<\/p>\n
Commissioynerv of 4’Corni_z1ereial Taxes [Intelligence &<\/p>\n
 Tranisition), Miy’-sore, revising the assessing order passed<\/p>\n
  the ‘Deputy Commissioner of Commercial Taxes<\/p>\n
 Mysore, the net result of which was to<\/p>\n
 enhaizceth\u00e9e sales tax liability of the assessee by an<\/p>\n
 “..fj.ax;VnO1int”‘ of Rs.1,07,776\/– by the Revisional Authority,<\/p>\n
‘   came to be set aside by the Appellate Tribunal<\/p>\n
 and therefore, the present revision petition by the<\/p>\n
Revenue. ‘\u00b0\u00a7\/<\/p>\n

3. The basis of enhancement by the Revisional
\nAuthority was that, on an inspection
\n24.12.2003, at the premises of the A’
\nestablishment, who was carrying’ on ‘_ of
\nHotels, restaurants etc., and
\nMysore City, the Inspecting”‘–of\ufb01cer   thell
\nactual number of empl.oyees”‘iiklio.’u’rere engaged in the
\nthree units, put together in number.\n<\/p>\n
whereas, as;    for the
\npurpose of” employees, the total
\nnumber’  had sent a factuai<\/p>\n
report     W .,  <\/p>\n
 “The lXs’ses_$iI\ufb01.g Authority who had this input<\/p>\n
 before passing the assessment order had examined this<\/p>\n
found the return filed by the assessee<\/p>\n
‘gindiclatineg  turnover of Rs.l,01,4l,927\/~ merited<\/p>\n
to “{facce’ptance, notwithstanding the inspection having<\/p>\n
‘  regvealed engagement of 16 daily wage workers on the<\/p>\n
 establishment for the reason that the dealer had<\/p>\n
maintained a meticulous account in the proper forms<\/p>\n

and had accounted for all his purchases and sales’ and<\/p>\n
therefore, mere fact of establishment comprisiiig-,,’s–orn,e<\/p>\n

the return itself.\n<\/p>\n
5. The Revisional   othenvise
\ngiving importance   report of the
\nInspecting Officers  ‘Lmade therein
\nthat the    on the premise
\nthat it   expenses and if
\nso, when  expenses go up because of<\/p>\n
the reason “of V’i.6Vi.ad.di_.tional casual employees and<\/p>\n
 adding the wagesvpaid to them during the year as part<\/p>\n
 \u00bbof”the estab1ish_ment expenses and on such premise, the<\/p>\n
 be a little more than what the dealer<\/p>\n
 had\u00e9\u00e9llin ‘fact declared and while the Assessing Authority<\/p>\n
 “..j’j~didl”ngotV’iind merit to accept this suggestion and the<\/p>\n
 reasoning of the inspecting authority, the Joint<\/p>\n
 Commissioner, exercising his revisionai power, though<\/p>\n
was required to look into the assessment order more<\/p>\n

the Kerala High Court and accordingly allowed the<\/p>\n
appeal, as per its order dated 17.1.2008.<\/p>\n
“.7. It is aggrieved by this order of   ~.. <\/p>\n
present revision petition by the feveimie\u00bb.  1 l ‘<\/p>\n
8. We have heard VSri..t:’g:.T.,K.\\\/ledarn’urtj:hy;Tlearnedll’
\nI-ICGP’ and Sri Advocate’ for the
\nassessee, who had  Qf this revision<\/p>\n
petition.\n<\/p>\n
9.__ 3 {earned HCGP would
\nsubmit that Authority, not acting on the
\nreport of’>the_  4 authority and in spite the<\/p>\n
inspecltirig aulthorityhaving indicated the manner of<\/p>\n
 \u00bbvvor1;i11g’outV”the possible turnover, nevertheless having<\/p>\n
ignoredvtiie the order obviously becomes an order<\/p>\n
 erro4neo’us.and prejudicial to the interest of the revenue<\/p>\n
A ..ji’var1d”\u00ab-..ca11s for revision and accordingly the revisional<\/p>\n
‘  order passed by the Joint Commissioner is in order and<\/p>\n
it no interference was warranted by the Tribunal; that, in<\/p>\n
fact, the revenue had piaced reliance on the judgment of<\/p>\n

the Kerala High Court which should have been followed<\/p>\n
and it is for this reason, the present revision petitio._n.._ 4<\/p>\n
10. On the other hand, Sri  .,
\nlearned Counsel appearing for
\nout that the Assessing Authorityllhald’
\nconvincing reasons    the
\nrecommendation of   that the
\ninspecting authority to suggest, in
\nwhat   made, but it is
\nthe du assessing authority;\n<\/p>\n
that the  having not indicated as to<\/p>\n
in what ‘p_’recisfe_  the order passed by the<\/p>\n
_ assessing authcarity was erroneous, further question of<\/p>\n
 \u00bbprejudice.,do_es not arise; that the revisional order is not<\/p>\n
ltenablely eitjherlfllon facts or in law and therefore, the<\/p>\n
   has allowed the appeal to set aside this<\/p>\n
‘ orderand restore the assessment order, there is nothing<\/p>\n
 iyrong in the order passed by the Tribunal and no<\/p>\n
 interference is warranted.\n<\/p>\n

11. Revision Petition under Section 23(1) of the
\nAct is one which can be examined by the High
\ninvolves a question of law which has  H

\nnot   manner the Assessing<\/p>\n
Authority  gariewrong, but is more obsessed with<\/p>\n
“V._4.,th\u00a7.._recommendationAof the inspecting authority being<\/p>\n
   Assessing Authority.\n<\/p>\n
A   the other hand, we find that the Assessing<\/p>\n
 had given cogent and convincing reasons, for<\/p>\n
 _ ‘ rejecting such recommendation and therefore, there was<\/p>\n
  …abse1uteiy no scope for the revisional authority to get<\/p>\n

active by exercising his powers under Section 21(2) of<\/p>\n
the Act.\n<\/p>\n
13. There is no merit in this revision  _<\/p>\n
