Justice ANTONY DOMINIC\n\n Dated :31\/01\/2011\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                        -------------------------\n                     Cont.Case 1028 of 2010\n                       --------------------------\n                Dated this the 31st January, 2011\n\n                          J U D G M E N T\n<\/pre>\n<p>     Complaining of non-compliance with the directions in<\/p>\n<p>Annexure-I judgment, this petition has been filed.          In<\/p>\n<p>Annexure-I judgment, this Court directed that the<\/p>\n<p>respondents therein will assess the available vacancies of<\/p>\n<p>Executive Officer-Gr.V and decide as to how             many<\/p>\n<p>vacancies are to be filled up and on that basis, will initiate<\/p>\n<p>steps for filling up of those vacancies. It is alleging that<\/p>\n<p>quantification of the vacancies in existence have not been<\/p>\n<p>done so far, this petition has been filed.        However, the<\/p>\n<p>definite stand taken by the respondent in the statement<\/p>\n<p>filed is that as at present there are no vacancies in the<\/p>\n<p>category of Executive Officer Gr.V to be filled up by<\/p>\n<p>promotion.\n<\/p>\n<p>     2.     Although the petitioner has disputed this<\/p>\n<p>assertion, respondent has again reiterated its stand in its<\/p>\n<p>additional statement      where reference is also made to<\/p>\n<p>Annexures R1 (a) to R1 (k).\n<\/p>\n<p>Cont.Case No. 1028 of 2010<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>      3.   In the light of this         stand taken by the<\/p>\n<p>respondent and the materials available, this Court is not in<\/p>\n<p>a position to conclude the issue in favour of the petitioner<\/p>\n<p>and therefore further proceedings in this petition will not<\/p>\n<p>be justified.  Therefore, the contempt petition has to be<\/p>\n<p>closed and I do so.\n<\/p>\n<p>      4.
