Justice KURIAN JOSEPH\n\n Dated :30\/07\/2009\n\n O R D E R\n        S.R.BANNURMATH, C.J. &amp; KURIAN JOSEPH, J.\n               ----------------------------------------------\n                   W.P.(C) No.21434 of 2009\n               ----------------------------------------------\n                       Dated 30th July, 2009.\n\n                           J U D G M E N T\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>           This writ petition has been filed, apparently in public<\/p>\n<p>interest, with the following prayers :-<\/p>\n<blockquote><p>                        (i) declare that Registering Authority under<br \/>\n            Registration Act are bound to register documents or<br \/>\n            conveyance       presented      for    registration without<br \/>\n            insisting stamp duty or registration fee on fair value<br \/>\n            which Sub Registrar deem fit as correct and proper.\n<\/p><\/blockquote>\n<blockquote><p>                        (ii) Issue a writ of mandamus or such other<br \/>\n            writ or order directing 1st and 2nd respondents to take<br \/>\n            steps directing Registering Authorities under them to<br \/>\n            register the document when presented without<br \/>\n            insisting payment of stamp duty or registration fee on<br \/>\n            fair value which according to the Registering Authority<br \/>\n            is correct and proper value.&#8221;\n<\/p><\/blockquote>\n<p>Learned Government Pleader on instruction submits that so far<\/p>\n<p>the Government has not notified fair value rates in the respective<\/p>\n<p>areas and hence all the registration authorities are free to<\/p>\n<p>register documents as presented by the parties showing the<\/p>\n<p>prevailing rates, without insisting for the market value as fixed by<\/p>\n<p>the registering authority. However, under law, in case it is found<\/p>\n<p>subsequently that the parties have not shown actual value or<\/p>\n<p><span class=\"hidden_text\">WP(C) NO.21434\/09                 2<\/span><\/p>\n<p>they have undervalued the property, the procedure in accordance<\/p>\n<p>with law for undervaluation would follow. The petitioner cannot<\/p>\n<p>have any objection with regard to that procedure.        The only<\/p>\n<p>grievance is with regard to the refusal on the part of the<\/p>\n<p>registering    authorities   registering the    documents   when<\/p>\n<p>presented.     In view of the submission made by the learned<\/p>\n<p>Government Pleader and noted by us above, the Registration<\/p>\n<p>Officers have to register the documents on the basis of the<\/p>\n<p>valuation at prevailing rates and as furnished in the documents,<\/p>\n<p>subject to their power to take appropriate action after<\/p>\n<p>registration, in case of alleged undervaluation.<\/p>\n<p>           The writ petition is disposed of as above.<\/p>\n<p>                                          S.R.BANNURMATH,<br \/>\n                                              Chief Justice.\n<\/p>\n<p>                                            KURIAN JOSEPH,<br \/>\n                                                  Judge.\n<\/p>\n<p>\ntgs<\/p>\n<p>         S.R.BANNURMATH, C.
