The Welfare officer mentioned in\nr. 74  (2) is  the same officer as is mentioned in\nr.  72\t(1)  which  rule  contemplates\ta  Welfare\nofficer appointed  in respect of one mine. But the\nappellant was  an officer  of several mines of the\nCompany and not of one of such mines only.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CIVIL APPELLATE  JURISDICTION:  Civil  Appeal<br \/>\nNo. 548 of 1958.\n<\/p>\n<p>     Appeal by Special Leave from the judgment and<br \/>\norder dated  March 27,\t1957, of  the  Patna  High<br \/>\nCourt in Misc. The  Judgment of\t the Court<br \/>\nwas delivered by<br \/>\n     SARKAR,  J.-on   September\t 25,   1947,   the<br \/>\nappellant was  appointed by  respondent No. 2, the<br \/>\nTata Iron  and Steel  Co., Ltd.\t (hereafter called<br \/>\nthe Company)  as the  Chief Labour  officer of its<br \/>\ncollieries of  which it appears to have a few, and<br \/>\nhe worked<br \/>\n<span class=\"hidden_text\">33<\/span><br \/>\nunder the  Company till\t the latter terminated his<br \/>\nservices by  a notice  dated December  5,1955.\tOn<br \/>\nsuch discharge,\t the appellant\t, claiming to be a<br \/>\nWelfare Officer\t of a  mine within  r.74(2) of the<br \/>\nMines Rules  1955, which  rule we  shall later ser<br \/>\nout, filed  an appeal  before respondent No.1, the<br \/>\nChief Inspector of Mines in India, under that rule<br \/>\nquestioning the\t validity of his discharged by the<br \/>\nCompany.  The\tChief  Inspector   held\t that  the<br \/>\nappellant was  not a  Welfare Officer  within that<br \/>\nrule and refused to entertain his appeal.\n<\/p>\n<p>     The appellant  then moved\tthe High  Court at<br \/>\nPatna under  Art. 226  of the  Constitution for an<br \/>\nappropriate writ  directing the chief inspector to<br \/>\ndecide the  appeal. The\t High Court  dismissed the<br \/>\nappellant&#8217;s petition  agreeing substantially  with<br \/>\nthe  view   taken  by  the  Chief  Inspector.  The<br \/>\nappellant has  now appealed  to this Court against<br \/>\nthe judgment of the High Court.\n<\/p>\n<p>     The Mines\tRules; 1955  were framed under the<br \/>\nMines Act  1952, and  came into\t force on  July 2,<br \/>\n1956.  We   are\t principally  concerned\t with  the<br \/>\nproviso for.  74(2) but\t this has  to be read with<br \/>\nr.72. The relevant portions of these rules are set<br \/>\nout below.\n<\/p>\n<p>\t  Rule 72.  (1) In  every mine wherein 500<br \/>\n     or more persons are ordinarily employed there<br \/>\n     shall  be\tappointed  at  least  one  Welfare<br \/>\n     Officer:-\n<\/p>\n<p>\t  Provided that\t if the\t number of persons<br \/>\n     ordinarily employed exceeds 2000, there shall<br \/>\n     be appointed  additional Welfare Officer on a<br \/>\n     scale  of\tone  for  every\t 2000  persons\tor<br \/>\n     fraction thereof-\n<\/p>\n<p>\t  (2) No person shall as a Welfare Officer<br \/>\n     of a mine unless he possesses-\n<\/p>\n<p>\t  (Here\t  certain    qualifications    are<br \/>\nspecified)<br \/>\n     Provided that  in case of a person already in<br \/>\nservice as a Welfare Officer in a mine the<br \/>\n<span class=\"hidden_text\">34<\/span><br \/>\n     above qualifications  may, with  the approval<br \/>\n     of the Chief Inspector be relaxed.<br \/>\n\t  (3)&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<br \/>\n\t  (4) A\t written notice\t of  ever  y  such<br \/>\n     appointment&#8230;..  and  of\tthe  date  thereof<br \/>\n     shall be  sent by the owner, agent or manager<br \/>\n     t o  the Chief  Inspector within  7 days from<br \/>\n     the\t  date\t\t of\t      such<br \/>\n     appointment&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<br \/>\n\t  Rule 73. Duties of Welfare officers:<br \/>\n\t  &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<br \/>\n&#8230;&#8230;&#8230;&#8230;.\n<\/p>\n<p>\t  (Here certain duties are prescribed)<br \/>\n\t  Rule\t\t\t\t       74.\n<\/p>\n<p>(1)&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<br \/>\n\t  (2)  The   condition\tof  service  of\t a<br \/>\n     Welfare Officer shall be the same as of other<br \/>\n     members of\t the staff of corresponding status<br \/>\n     in the mine;\n<\/p>\n<p>\t  Provided that\t in the\t case of discharge<br \/>\n     or dismissal, the Welfare Officer, shall have<br \/>\n     a right  of appeal\t to  the  Chief\t Inspector<br \/>\n     whose decision  thereon shall  be\tfinal  and<br \/>\n     binding upon  the owner,  agent or manager of<br \/>\n     the mine as the case may be.\n<\/p>\n<p>The Chief  Inspector mentioned\tin these  Rules is<br \/>\nthe Chief Inspector of Mines in India.\n<\/p>\n<p>     If the  appellant was  not a  Welfare officer<br \/>\nwithin the  proviso to\tr. 74(2)  as  the  company<br \/>\ncontends, then,\t of course,  no appeal\tby him lay<br \/>\nunder it. He would then clearly not be entitled to<br \/>\nthe writ  he  asked.  The  question  therefore\tis<br \/>\nwhether the appellant was a Welfare Officer within<br \/>\nthe rule and is really one of construction of it.\n<\/p>\n<p>     We desire\tnow to\tpoint out certain facts as<br \/>\nto which  there is no controversy. First, both the<br \/>\nAct and\t the Rules  came into force long after the<br \/>\nappellant  had\tbeen  appointed\t by  the  Company.<br \/>\nSecondly no  relaxation of qualifications had been<br \/>\nsought from or granted by the Chief Inspector with<br \/>\nrespect to<br \/>\n<span class=\"hidden_text\">35<\/span><br \/>\nThe appellant  under the  proviso to sub-r. (2) of<br \/>\nr. 72  after the  Rules came in to force. Thirdly,<br \/>\nno notice  as contemplated   in\t r. 72(4) had been<br \/>\ngiven concerning  the appellant.  It appears  that<br \/>\nthe Chief  Inspector found that the appellant &#8220;was<br \/>\nperforming  duties   akin  to\tthose  of  Welfare<br \/>\nofficers  contemplated\tby  rule  73  and  he  was<br \/>\nqualified  to  work  as\t a  Welfare  officer.&#8221;\tWe<br \/>\npropose to  deal with  this appeal on the basis of<br \/>\nthese findings.\n<\/p>\n<p>     Dealing with  the contention  noticed by  the<br \/>\nChief Inspector\t and the High Court that a Welfare<br \/>\nOfficer under  r. 74(2)\t is one\t who is\t appointed<br \/>\nafter the  Rules came  into force, Mr. Sen for the<br \/>\nappellant said\tthat a\tperson like  the appellant<br \/>\nwho  had  the  requisite  qualifications  and  was<br \/>\ndischarging the\t duties prescribed  for a  Welfare<br \/>\nofficer from  before the  Rules came  into  force,<br \/>\nwould be a Welfare officer within them. He pointed<br \/>\nout that  the proviso  to  sub-r.  (2)\tof  r.\t72<br \/>\nclearly\t contemplated\tthe  continuance   of  the<br \/>\nservice of such a person as a Welfare officer with<br \/>\nrelaxation  where   such  was  necessary  and  was<br \/>\ngranted. He also said that sub-r. (4) of r. 72 was<br \/>\ninapplicable to\t Such a person because he had been<br \/>\nappointed long\tago and\t because the proviso to r.<br \/>\n72(2)  indicated  that\tits  application  was  not<br \/>\nintended.  We\tdo  not\t  think\t it  necessary\tto<br \/>\npronounce on this question in the present case. In<br \/>\nour view,  the appeal  must fail even if Mr. Sen&#8217;s<br \/>\ncontention is right and that for another reason .\n<\/p>\n<p>     We observe\t that the  Rules do not define the<br \/>\nterm &#8220;Welfare  officer&#8221;. But we think it is beyond<br \/>\ndoubt-and  indeed   the\t contrary   has\t not  been<br \/>\ncontended that\tthe Welfare  officer mentioned\tin<br \/>\nthe proviso  to r. 74(2) is the same officer as is<br \/>\nmentioned in sub-r (1) of r. 72. Now it is, in our<br \/>\nview, perfectly\t plain that  the  Welfare  officer<br \/>\ncontemplated by r. 72(1) is such an officer of one<br \/>\nmine. The  rule says  that there shall be at least<br \/>\none  Welfare  officer  for  every  mine\t employing<br \/>\nbetween 500  and 2000  persons and  this makes any<br \/>\nother view impossible<br \/>\n<span class=\"hidden_text\">36<\/span><br \/>\nAs we  understood Mr.  Sen, he\talso accepted that<br \/>\nthe Welfare  officer contemplated is one appointed<br \/>\nin respect  of one mine. Now, the appellant was on<br \/>\nhis own case, the Welfare Officer of several mines<br \/>\nof the\tCompany and not of one of such mines only.<br \/>\nTherefore, we  think that  he was  not\ta  Welfare<br \/>\nofficer within\tr. 72(1)  and hence not within the<br \/>\nproviso to r. 74(2).\n<\/p>\n<p>     But Mr. Sen contends that the appellant might<br \/>\nbe  considered\t as  having   been  severally  and<br \/>\nindependently appointed\t the  Welfare  officer\tof<br \/>\neach of\t the Company&#8217;s\tseveral collieries  in his<br \/>\ncharge. We  think that would be an impossible view<br \/>\nto take.  One appointment  cannot  be  treated\tas<br \/>\nseveral appointments and it is not in dispute that<br \/>\nthe appellant had only one appointment for all the<br \/>\nCompany&#8217;s collieries.\n<\/p>\n<p>     We\t think\tthat  this  appeal  fails  and\twe<br \/>\ndismiss it with costs.\n<\/p>\n<p>\t\t\t\t Appeal dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India 32Dhagamwar Narsingh vs S.
