SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/10\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India the petitioner-Surendranagar District Panchayat has prayed<br \/>\nfor an appropriate writ, order or direction quashing and setting<br \/>\naside the impugned judgement and award dated 10\/01\/2003 passed by the<br \/>\nlearned Presiding Officer, Labour Court, Surendranagar in Reference<br \/>\n(L.C.S.) No. 8\/1997 by which the Labour Court has allowed the<br \/>\nReference ex parte directing the petitioner to reinstate the<br \/>\nrespondent to his original post with full back wages and continuity<br \/>\nin service.\n<\/p>\n<p>2\tThe<br \/>\nrespondent was appointed as part time peon on purely temporary and ad<br \/>\nhoc basis in the Primary Health Center run by the petitioner  and he<br \/>\nwas offered  the work as and when work was available.  However, he<br \/>\nwas relieved in the year 1996, for which the respondent raised an<br \/>\nindustrial dispute, which was referred to the Labour Court,<br \/>\nSurendranagar, which was numbered as Reference (L.C.S) No. 8\/1997.<br \/>\nIt appears that though served, for whatever reason and in view of<br \/>\nusual negligence on the part of the Officer of the<br \/>\npetitioner-Panchayat, nobody filed reply and contested the said<br \/>\nReference and, therefore, accepting whatever was submitted by the<br \/>\nrespondent in the statement of claim and his deposition, the Labour<br \/>\nCourt vide impugned judgement and award dated 10\/01\/2003 held that<br \/>\nthere was breach of Sections 25 F and H of the Industrial Disputes<br \/>\nAct and consequently allowed the Reference directing the petitioner<br \/>\nto reinstate the respondent to his original post with full back<br \/>\nwages.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the nature of appointment of the respondent<br \/>\nas part time peon and considering the affidavit filed on behalf of<br \/>\nthe petitioner dated 22\/04\/2004 it appears to the Court that merely<br \/>\nbecause of the negligence on the part of the Officer of the<br \/>\npetitioner-Panchayat, the Panchayat should not be made to suffer as<br \/>\nultimately whatever is required to be paid by the Panchayat would be<br \/>\nfrom the public exchequer, and, therefore, in the facts and<br \/>\ncircumstances of the case, this Court is of the opinion that if the<br \/>\nmatter is remanded to the Labour Court for deciding the same afresh<br \/>\ngiving one additional opportunity to decide the Reference and to lead<br \/>\nthe evidence on imposing reasonable cost and on continuing to pay the<br \/>\nwages under Section 17B of the Industrial Disputes Act to the<br \/>\nrespondent, which is being paid to him till  final disposal of the<br \/>\nReference, it will meet the ends of justice and no prejudice shall be<br \/>\ncaused to the respondent.\n<\/p>\n<p>4.\tShri<br \/>\nKoshti, learned advocate appearing on behalf of the respondent has<br \/>\nsubmitted that as such there is an absolute negligence on the part of<br \/>\nthe Officer of the petitioner-Panchayat and, therefore, no<br \/>\nirregularity has been committed by the Labour Court and whatever was<br \/>\nproduced on that basis  the Labour Court has passed the impugned<br \/>\norder.  It is further submitted by Shri Koshti, learned advocate<br \/>\nappearing on behalf of the respondent that if this Court is of the<br \/>\nopinion that the matter be remanded to the Labour Court the same may<br \/>\nbe remanded but without any liberty in favour of the petitioner to<br \/>\nlead fresh evidence.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the impugned judgement and award and the<br \/>\nadditional affidavit filed by the petitioner  and the nature of<br \/>\nappointment  of the respondent as part time employee initially for<br \/>\nthree hours a day and thereafter for six hours a day that too as and<br \/>\nwhen work was available he was offered the work, this Court is of the<br \/>\nopinion that despite the negligence on the part of the Officer of the<br \/>\npetitioner-Panchayat and so as to give one additional opportunity to<br \/>\nthe petitioner to defend the Reference by leading evidence,  if the<br \/>\nmatter is remanded to the Labour Court on imposing reasonable cost<br \/>\nand  on  continuing to pay the award under Section 17B of the<br \/>\nIndustrial Disputes Act to the respondent till final disposal of the<br \/>\nReference, it will sub-serve the ends of justice and no prejudice<br \/>\nshall be caused to the respondent as in the meantime he will be<br \/>\ngetting the award under Section 17B of the Industrial Disputes Act.<br \/>\nThe submission on behalf of Shri Koshti, learned advocate appearing<br \/>\non behalf of the respondent that the matter can be remanded but<br \/>\nwithout reserving any liberty in favour of the petitioner to lead the<br \/>\nevidence cannot be accepted.  If such a liberty is not reserved the<br \/>\npurpose for which the matter  is to be remanded will be frustrated.<br \/>\nThis Court is of the opinion that for the negligence on the part of<br \/>\nthe Officer of the petitioner-Panchayat, the Panchayat should not be<br \/>\nmade to suffer as ultimately whatever amount the Panchayat is to pay<br \/>\nthe burden would be upon the public exchequer and, therefore, to<br \/>\nstrike the balance,  if the aforesaid course is adopted it will meet<br \/>\nthe ends of justice.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the<br \/>\nimpugned judgement and order dated 10\/01\/2003 passed by the learned<br \/>\nPresiding Officer, Labour Court, Surendranagar in Reference (L.C.S)<br \/>\nNo. 8\/1997 is hereby quashed and set aside and the matter is remanded<br \/>\nto the Labour Court, Surendranagar for deciding the same afresh in<br \/>\naccordance with law on its own merits and on payment of cost by the<br \/>\npetitioner to the respondent, which is quantified at Rs. 15,000\/-, to<br \/>\nbe deposited by the petitioner with the Labour Court, Surendranagar<br \/>\nwithin a period of eight weeks from today and without prejudice to<br \/>\nthe rights and contentions of the respective parties subject to the<br \/>\nultimate outcome of the Reference, on remand, the respondent is<br \/>\ncontinued to be paid  whatever the wages is being paid under Section<br \/>\n17B of the Industrial Disputes Act till final disposal of the<br \/>\nReference.  It will be open for the respective parties to lead the<br \/>\nevidence afresh and the Labour Court to pass an appropriate order in<br \/>\naccordance with law on its merits and on appreciation of the evidence<br \/>\nthat may be led.  Rule is made absolute to the aforesaid extent.
