Justice K.K.DENESAN\n\n Dated :19\/12\/2006\n\n O R D E R\n                              K.K.DENESAN, J.\n\n                    -----------------------------\n\n                        WP(C)No. 31235 OF 2006\n\n                    -----------------------------\n\n                Dated this the 19th December, 2006.\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>      The   petitioner   is   working   as   Assistant   Public<\/p>\n<p>Prosecutor Gr.II with effect from 16.6.2006 in the Court of<\/p>\n<p>the   Judicial   First   Class   Magistrate,   Ottapalam.     Her   term<\/p>\n<p>of   appointment   as   shown   in   the   appointment   order   was   over<\/p>\n<p>by  15th  of  this  month.     This  Court  passed  an  interim  order<\/p>\n<p>directing   the   respondents   to   permit   the   petitioner   to<\/p>\n<p>continue in the post.\n<\/p>\n<p>      2.     The   Government   have   issued   the   select   list   of<\/p>\n<p>Assistant   Public   Prosecutors   Gr.II   for   regular   appointment<\/p>\n<p>and   a   substantial   number   of   candidates   included   in   the<\/p>\n<p>select   list   are   undergoing   training   for   a   period   of   six<\/p>\n<p>months.   The   point   for   consideration   is   until   such   time   the<\/p>\n<p>trained   hands   report   for   duty,   why   not   the   petitioner   be<\/p>\n<p>permitted   to   continue   on   temporary   basis?   I   am   of   the<\/p>\n<p>opinion   that   the   petitioner   can   be   allowed   to   continue   in<\/p>\n<p>the   post   temporarily   until   the   regular   hand   reports   for<\/p>\n<p>duty.     This   is   so   in   the   light   of   the   ruling   of   the   apex<\/p>\n<p>Court   in  Raj   Deo   Sharma   v.   State   of   Bihar  {2000(1)   KLT   SC<\/p>\n<p>463}.     The   information   collected   by   this   Court   through   the<\/p>\n<p>Registrar   shows   that   there   are   no   complaints   against   the<\/p>\n<p>petitioner.\n<\/p>\n<p><span class=\"hidden_text\">WPC 31235\/2006                     2<\/span><\/p>\n<p>      3.
