     Plaintiff   in   O.S.No.1514\/03   on   the   file   of<\/p>\n
Munsiff         Court,         Thrissur         is         the         appellant.\n<\/p>\n
Defendants   are   respondents.     The   appellant   filed<\/p>\n
the   suit   seeking   a   decree   for   a   declaration   that<\/p>\n
defendants   are   not   entitled   to   proceed   against   the<\/p>\n
movable   properties   in   the   building   TC     19-540(V\/A)<\/p>\n
and   restraining   defendants   from   realising   the<\/p>\n
building   tax   from   the   appellant   or   his   properties.\n<\/p>\n
The   case   of   the   appellant   was   that   the   building<\/p>\n
against which assessment proceedings were initiated<\/p>\n
under   Kerala   Building   Tax   Act,   does   not   belong   to<\/p>\n
the   appellant   but   to   his   father   and   when   Ext.A1<\/p>\n
notice was served directing him to produce approved<\/p>\n
plan and returns, he sent Ext.A2 reply stating that<\/p>\n
he is not the owner of the building and his father<\/p>\n
is   the   owner   and   therefore   the   proceedings   has   to<\/p>\n
be initiated against his father and he is not in a<\/p>\n

position   to   produce   the   approved   plan   and   return<\/p>\n
and   still   Ext.A3   order   was   passed   asssessing   a<\/p>\n
building   tax   of   Rs.51,600\/-   as   against   the<\/p>\n
appellant.     Appellant   contended   that   as   he   is   not<\/p>\n
the owner or the assessee, he is not liable to pay<\/p>\n
the   building   tax   and   respondents   are   not   entitled<\/p>\n
to  proceed  against  him  or  his  movable  or  immovable<\/p>\n
properties   for   realisation   of   the   building   tax.\n<\/p>\n
Respondents   filed   a   written   statement   contending<\/p>\n
that the suit is barred under section 27 of Kerala<\/p>\n
Building Tax Act and   appellant is not entitled to<\/p>\n
the   decree   sought   for.   Learned   Munsiff   on   the<\/p>\n
evidence   of   PW1   and   Ext.A1   to   A9,   dismissed   the<\/p>\n
suit  holding  that  the  suit  is  barred  under  section<\/p>\n
27   of   the   Building   Tax   Act.   Appellant   challenged<\/p>\n
the   decree   and   judgment   before   Additional   District<\/p>\n
Court, Thrissur in A.S.176\/05.   Learned Additional<\/p>\n
District   Judge   on   reappreciation   of   evidence<\/p>\n
confirmed   the   decision   of   the   learned   Munsiff   and<\/p>\n
dismissed   the   appeal.     It   is   challenged   in   the<\/p>\n
second appeal.\n<\/p>\n

      2.  Learned counsel appearing for the appellant<\/p>\n
was heard.\n<\/p>\n
      3.     The   argument   of   learned   counsel   appearing<\/p>\n
for   appellant   was   that     appellant   is   neither   the<\/p>\n
owner   nor   the     assessee   who   is   liable   to   pay<\/p>\n
building   tax   and   his   case   is   that   he   cannot   be<\/p>\n
assessed   for   the   building   tax   under   the   provisions<\/p>\n
of Building Tax Act as the building does not belong<\/p>\n
to   him   as   he   is   not   an   owner   as   defined   under   the<\/p>\n
Act,   and   therefore   he   cannot   be   proceeded   for<\/p>\n
realisation of the building tax and   Section 27 of<\/p>\n
the   Kerala   Building   Tax   Act,   1975   does   not   apply<\/p>\n
and     courts   below   should   have   granted   the   decree<\/p>\n
sought for.\n<\/p>\n
      4.     Section   27   of     Kerala   Building   Tax   Act,<\/p>\n
1975 reads:-\n<\/p>\n
            “Bar   of   suits   etc.   in<\/p>\n
            courts- No suit shall be<\/p>\n
            brought   in   any   civil<\/p>\n
            court   to   set   aside   or<\/p>\n
            modify   any   assessment<\/p>\n

            made   under   this   Act   and<\/p>\n
            no   prosecution,   suit   or<\/p>\n
            other   proceeding   shall<\/p>\n
            lie         against                 the<\/p>\n
            Government          or              any<\/p>\n
            authority or officer for<\/p>\n
            anything   in   good   faith<\/p>\n
            done   or   intended   to   be<\/p>\n
            done under this Act.”\n<\/p><\/blockquote>\n
Under the said section, no suit could be instituted<\/p>\n
before a civil court either to set aside or modify<\/p>\n
any   assessment   made   under   the   Act.     Section   9   of<\/p>\n
the Act deals with   assessment.   Under sub section<\/p>\n
(1)   of   Section   9,   if   the   assessing   authority   is<\/p>\n
satisfied   that   a   return   made   by   an   owner   under<\/p>\n
section 7 or section 8 is correct and complete, it<\/p>\n
shall  assess  the  amount  payable  by  him  as  building<\/p>\n
tax on the basis of the return.   Under sub section<\/p>\n
(2),   if   the   assessing   authority   is   not   so<\/p>\n
satisfied,  it  shall  serve  a  notice  on  the  assessee<\/p>\n
either to attend in person at its office on a date<\/p>\n

to   be   specified   in   the   notice   or   to   produce   or<\/p>\n
cause   to   be   produced   on   that   date   any   evidence   on<\/p>\n
which   the   assessee   may   rely   in   support   of   his<\/p>\n
return.         Under   sub   section   (3)   the   assessing<\/p>\n
authority,   after   hearing   such   evidence   as   the<\/p>\n
assessee  may  produce  and  such  other  evidence  as  it<\/p>\n
may   require   on   any   specified   point   and   after<\/p>\n
conducting   such   inquiries   or   inspection   as   it   may<\/p>\n
consider   necessary,   shall   by   order   in   writing,<\/p>\n
assess the amount payable by him as building tax.\n<\/p>\n
      5.   Ext.A1 notice was issued as provided under<\/p>\n
sub   section   (2)   of   Section   9.     Ext.A3   order   was<\/p>\n
passed   as   provided   under   sub   section   (3)   assessing<\/p>\n
the   amount   payable   by   the   appellant   as   building<\/p>\n
tax.     Sub   clause   (c)   of   Section   2   of   the   Act<\/p>\n
defines an assessee as follows:-\n<\/p>\n
          “assessee”   means   a   person<\/p>\n
          by   whom   building   tax   or<\/p>\n
          any other sum of money is<\/p>\n
          payable   under   this   Act<\/p>\n
          and   includes   every   person<\/p>\n

          in   respect   of   whom   any<\/p>\n
          proceeding   under   this   Act<\/p>\n
          has   been   taken   for   the<\/p>\n
          assessment         of              the<\/p>\n
          building   tax   payable   by<\/p>\n
          him.\n<\/p><\/blockquote>\n
As   per   the   definition,   a   person   by   whom   building<\/p>\n
tax or any other sum of money is payable under the<\/p>\n
Act   is   an   assessee.   The   argument   of          learned<\/p>\n
counsel   appearing   for   appellant   was   that   building<\/p>\n
tax under the Act is payable only  by the owner and<\/p>\n
as defined under clause (i) “owner” could only be a<\/p>\n
person   who   for   the   time   being   is   receiving   or   is<\/p>\n
entitled to receive   rent of any building, whether<\/p>\n
on   his   own   account   or   on   account   of   anybody   else<\/p>\n
and   therefore   appellant     cannot   be   an   assessee.\n<\/p>\n
The   argument   could   have   been   accepted   if   the<\/p>\n
definition   of   assessee   is   limited   to   a   person   by<\/p>\n
whom   building   tax   is   payable.     But   as   per   the<\/p>\n
definition,   an   assessee   includes   every   person   in<\/p>\n
respect   of   whom   any   proceeding   under   this   Act   has<\/p>\n

been   taken   for   the   assessment   of   the   building   tax<\/p>\n
payable   by   him.     When   a   notice,   as   contemplated<\/p>\n
under   sub   section   (2)   of   Section   9   was   issued   to<\/p>\n
the  appellant  proposing  to  assess  the  building  tax<\/p>\n
payable   by   him     and   subsequent   to   that   notice<\/p>\n
under   sub   section   (3),   an   order   was   passed<\/p>\n
assessing   the   building   tax             payable   by   the<\/p>\n
appellant,  it need no further explanation  to hold<\/p>\n
that appellant is an assessee as defined under the<\/p>\n
Act,   as   proceedings   under   the   Act   has   been   taken<\/p>\n
for   the   assessment   of   the   building   tax   payable   by<\/p>\n
him.\n<\/p>\n
      6.   Section   11   provides   that   an   assessee<\/p>\n
objecting   to   the   amount   of   building   tax   assessed<\/p>\n
under   section   9   or   denying   his   liability   to   be<\/p>\n
assessed   under   the   Act,   or   objecting   to   any   order<\/p>\n
of the assessing authority under the Act may appeal<\/p>\n
to   the   Appellate   Authority   against   the   assessment<\/p>\n
or against such order.   Hence it is clear from sub<\/p>\n
section   (1)   of   Section   11,   that   any   person   who   is<\/p>\n
assessed   to     building   tax   under   section   9(3)   and<\/p>\n

who   is   denying   his   liability   to   be   assessed   under<\/p>\n
the   Act   or   who   is   objecting   to   any   order   of   the<\/p>\n
assessing   authority   is   entitled   to   file   an   appeal<\/p>\n
against   the   order   of   assessment.     If   that   be   so,<\/p>\n
under   section   27,   the   suit   is   definitely   barred.\n<\/p>\n
No   substantial   question   of   law   arises   for<\/p>\n
consideration   in   the   appeal.            The   appeal   is<\/p>\n
dismissed.\n<\/p>\n
      Learned   counsel   appearing   for     appellant   then<\/p>\n
submitted  that  the  period  for  preferring  an  appeal<\/p>\n
has     expired   and     appellant   may     be   granted   an<\/p>\n
opportunity   to   file   an   appeal   as   provided   under<\/p>\n
section   11.     Appellant   is   entitled   to   file   an<\/p>\n
appeal   as   provided   under   the   Act.     The   question<\/p>\n
whether     delay   could   be   condoned   or   not   is   to   be<\/p>\n
decided by the authority under the Act.\n<\/p>\n
