DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered<br \/>\n\tbeing  CR No.I &#8211; 67 of 2010 with Dhrangadhra City Police Station for<br \/>\n\tthe offences punishable under Sections 306 and 114 of the Indian<br \/>\n\tPenal Code and under Sections 25, 33 and 34 of the Bombay Money<br \/>\n\tLenders Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicant has submitted that even the version of the<br \/>\n\tdeceased recorded as Dying Declaration, it reveals that at the most<br \/>\n\tthe applicant had insisted for return of the money borrowed by the<br \/>\n\tdeceased and simplicit, it cannot be said that the above alleged<br \/>\n\taction of the applicant is the case for which Section 306 is<br \/>\n\tattracted. It is further submitted that the co-accused is enlarged<br \/>\n\ton bail by this Court and, therefore, by imposing suitable<br \/>\n\tconditions, the applicant may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tMrs.Krina Calla, learned APP appearing on behalf of the respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase, considering the overall facts and circumstances and the<br \/>\n\tco-accused is enlarged on bail, I am inclined to  grant Anticipatory<br \/>\n\tBail on  imposing suitable  conditions.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tCR No.I &#8211; 67 of 2010 with Dhrangadhra City Police Station,  the<br \/>\n\tapplicant shall be released on bail on furnishing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand only) with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 29.12.2010 at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>With<br \/>\n\tthese directions, this Criminal Misc. Application is disposed of.<br \/>\n\tRule is made absolute. Direct Service is permitted.\n<\/p>\n<p>(ANANT<br \/>\n\tS.
