Justice ANTONY DOMINIC\n\n Dated :18\/11\/2010\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                       -------------------------\n                  W.P (C) No.33228 of 2010\n                      --------------------------\n             Dated this the 18th November, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioner states that he purchased 61 cents of land<\/p>\n<p>in   R.Sy. No.2 of Keezhattoor Desom in Taliparamba<\/p>\n<p>Amsom. According to the petitioner, aggrieved by the fair<\/p>\n<p>value fixed for the property , he filed an appeal under<\/p>\n<p>Section 28A of the Kerala Stamp Act. That appeal was<\/p>\n<p>rejected by Ext.P7 order. Consequently the appeal filed<\/p>\n<p>under Section 45A (4) also was also rejected by Ext.P8. It<\/p>\n<p>is challenging the aforesaid orders, this writ petition is<\/p>\n<p>filed.\n<\/p>\n<p>      2.    The main contention raised by the learned<\/p>\n<p>counsel for the petitioner was while passing Ext.P7 order<\/p>\n<p>the District Collector did not take note of the prevailing<\/p>\n<p>value in the neighbouring properties.               When that<\/p>\n<p>contention was raised, by order dated 2.11.2010, this<\/p>\n<p>Court directed the counsel for the petitioner to produce<\/p>\n<p>the   documents      of    neighbouring         properties for<\/p>\n<p>substantiating his contentions.\n<\/p>\n<p>      3.    In compliance with said direction, petitioner has<\/p>\n<p>W.P (C) No.33228 of 2010<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>filed I.A No.15766 of 2010       producing Exts.P9 to P13<\/p>\n<p>documents which according to the petitioner,             were<\/p>\n<p>executed in relation to the properties in the neighbouring<\/p>\n<p>locality and which shows that the value of the lands is less<\/p>\n<p>than the fair value fixed by the Government.<\/p>\n<p>      4.    Obviously, when Ext.P7 order was passed by the<\/p>\n<p>District Collector, the District Collector did not have<\/p>\n<p>occasion to refer to Exts. P9 to P13.    In that view of the<\/p>\n<p>matter and since the petitioner has produced the aforesaid<\/p>\n<p>documents, I am inclined to think that Ext.P5 appeal filed<\/p>\n<p>by the petitioner resulting in Ext.P7 has to be reconsidered.<\/p>\n<p>In order to enable the District Collector to reconsider<\/p>\n<p>Ext.P5 appeal filed by the petitioner, I set aside Ext.P7.<\/p>\n<p>      5.    Petitioner shall produce Exts.P9 to P13 before<\/p>\n<p>the District Collector. This shall be done by the petitioner<\/p>\n<p>within two weeks from the date of receipt of a copy of this<\/p>\n<p>judgment. It is directed that if the petitioner produces the<\/p>\n<p>aforesaid documents, Ext.P5 will be reconsidered with<\/p>\n<p>notice to the petitioner and as expeditiously as possible, at<\/p>\n<p>any rate, within four weeks thereafter.
