Justice P.S.GOPINATHAN\n\n Dated :24\/02\/2010\n\n O R D E R\n             THOTTATHIL B.RADHAKRISHNAN\n                                     &amp;\n                     P.S.GOPINATHAN, JJ.\n                 -------------------------------------------\n                    W.P(Crl).No.23 OF 2010\n                 -------------------------------------------\n            Dated this the 24th day of February, 2010\n\n\n                             JUDGMENT\n<\/pre>\n<p>Thottathil B.Radhakrishnan, J.\n<\/p>\n<\/p>\n<p>1.The petitioner states that he is the father of the detenue<\/p>\n<p>  Sanish who was detained in terms of Ext.P1 detention order<\/p>\n<p>  under the provisions of the Kerala Anti Social Activities<\/p>\n<p>  (Prevention) Act, 2007, hereinafter, the &#8216;Act&#8217;, for short. The<\/p>\n<p>  detention order was issued on 2.8.2009 by the competent<\/p>\n<p>  authority but was enforced by securing detention only on<\/p>\n<p>  23.11.2009.  The petitioner has two grounds. Firstly, it is<\/p>\n<p>  contended that there is inordinate unexplained delay between<\/p>\n<p>  the detention order and the enforcement of the detention and<\/p>\n<p>  that with such passage of time, it needs to be held that the<\/p>\n<p>  detention order has turned out to be one which could not be<\/p>\n<p>  enforced without a further due formulation of mind regarding<\/p>\n<p>WPCR.23\/10<\/p>\n<p><span class=\"hidden_text\">                               2<\/span><\/p>\n<p>  the requirement for detention. Secondly, it is argued that the<\/p>\n<p>  ground of detention in terms of the recommendations of the<\/p>\n<p>  reporting authority is &#8216;Known Rowdy&#8217; whereas the impugned<\/p>\n<p>  detention order has been issued by holding that the said<\/p>\n<p>  person is a &#8216;Known Goonda&#8217;.\n<\/p>\n<\/p>\n<p>2.Dilating on the relevant provisions of the Act, this Court has<\/p>\n<p>  held in W.P(Crl).No.456\/09 and connected cases that the<\/p>\n<p>  conclusions arrived at with a person is a &#8216;Goonda&#8217; and<\/p>\n<p>  therefore a &#8216;Known Goonda&#8217; on similar facts, is insufficient to<\/p>\n<p>  sustain an order of detention.    With this, we find that the<\/p>\n<p>  impugned detention order cannot be sustained.<\/p>\n<p>3.In the result, this writ petition is allowed quashing Ext.P1<\/p>\n<p>  order and setting aside the detention of the detenue Sanish. If<\/p>\n<p>  the detention of the detenue is not necessary in connection<\/p>\n<p>  with any other case, he shall forthwith be released by the<\/p>\n<p>WPCR.23\/10<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><\/p>\n<p> prison authorities.
