JEEVAN REDDY, J.:\n<\/p>\n<p>1.   This writ petition under Article 32 of the Constitution<br \/>\nis  filed by the People&#8217;s Union for Civil  Liberties  (PUCL)<br \/>\nfor  the issuance of an appropriate direction instituting  a<br \/>\njudicial enquiry to enquire into the incidents mentioned  in<br \/>\nthe  writ  petition and to further  direct  the\t respondents<br \/>\n(Union of India and State of Manipur) to take action against<br \/>\nthe  erring  police  officers.\t A  direction  for  awarding<br \/>\ncompensation to the members of the family of the deceased is<br \/>\nalso prayed for.\n<\/p>\n<p>2.   The  petitioner  says that on 3rd April,  1991  a\tfake<br \/>\nencounter  was\tstaged\tby the\tImphal\tDistrict  Police  in<br \/>\nLunthilian  village  in Churachandpur District\twherein\t two<br \/>\npersons viz., Lalbeiklien s\/o Thatngur of Lunthilian village<br \/>\nand Saikaplien, s\/o Tenga of Tingbum village of Mizoram were<br \/>\nkilled.\t  It is alleged that a false FIR was lodged  by\t the<br \/>\nDistrict  Police  at Imphal Police Station at 4.30  p.m.  on<br \/>\n4.4.1991 wherein it was alleged that on receipt of  reliable<br \/>\ninformation to the effect that some hardcore leaders of\t the<br \/>\nHamar  People&#8217;s Convention (HPC) were camping at  Lunthilian<br \/>\nvillage, they rushed to the village on 3.4.91 and that\twhen<br \/>\nthey  reached the village at about 11.00 p.m. on  that\tday,<br \/>\nthey  were  fired upon by the members of the  HPC.   It\t was<br \/>\nalleged\t that  in the exchange of fire,\t the  two  aforesaid<br \/>\npersons\t died  made three others were apprehended.   It\t was<br \/>\nalso stated that the police recovered a.22 country  revolver<br \/>\nwith seven rounds of ammunition, a cash amount of Rs. 1,213\/\n<\/p>\n<p>&#8211;  and\ta large number of incriminating document-,.   It  is<br \/>\nstated by the petitioner in the writ petition that the above<br \/>\nversion of the police is strongly denied by the relatives of<br \/>\nthe said deceased persons.  According to them, no  encounter<br \/>\nas such took place in the village and not a single shot\t was<br \/>\nfired.\t According  to them, the said two  deceased  persons<br \/>\nwere  taken away by the police and killed in a\tcold-blooded<br \/>\nmanner\tand that this version is corroborated  by  villagers<br \/>\nwho  were present when be said persons were taken  away\t and<br \/>\nalso  from  the various reports appearing in the  local\t and<br \/>\nnational  media.   According to the petitioner\tfurther\t the<br \/>\ntrue  case is that the Police came to the village  at  about<br \/>\n9.30  p.m. on that day and took away five persons  including<br \/>\nthe  two  deceased.   They took away  the  Chairman  of\t the<br \/>\nVillage also with them, but he was let-off on the out-\n<\/p>\n<p><span class=\"hidden_text\">366<\/span><\/p>\n<p>skirts\tof the village.\t Remaining five persons\t were  taken<br \/>\naway in a truck after blindfolding them.  At about 2.00 p.m.<br \/>\non  4.4.91,  i.e., after travelling for about 16  hours\t and<br \/>\nafter  crossing the Lanva Bridge which is about 5  km.\tfrom<br \/>\nChurachandpur,\tthe two deceased were called by\t the  police<br \/>\nand  taken  away  from the back They,  were  taken  to\tsome<br \/>\ndistance and shot there.  The remaining three persons in the<br \/>\ntruck  heard  the gunshots.  Subsequently, the\tdead  bodies<br \/>\nwere dumped in the truck and taken to Imphal where the other<br \/>\nthree  persons\twere kept in the Imphal Police\tStation\t for<br \/>\nfour  days.   Then they were taken to  Churachandpur  Police<br \/>\nStation\t and  were kept there for about 9 days.\t  They\twere<br \/>\nthen brought back to Imphal Police Station and lodged in the<br \/>\nImphal\tCentral\t Jail.\tTen days later they  were  taken  to<br \/>\nMizoram where they were released on bail on 22.7.1991. The<br \/>\naffidavits of two of the said three\tpersons,       viz.,<br \/>\nRemthang and Lalsansuot, sworn\t  before    the\t    Judicial<br \/>\nMagistrate,  1\tClass  on  20th\t August,  1991,\t are   filed<br \/>\nalongwith  the writ petition.  Affidavits of  villagers\t and<br \/>\nwives of the deceased are also filed in support of the above<br \/>\nversion.   The writ petition then sets out, what  it  calls,<br \/>\nthe  serious lacunae, irregularities and inconsistencies  in<br \/>\nthe  version put forward by the police, vide para 7  of\t the<br \/>\nwrit petition.\n<\/p>\n<p>3.   On 13th November, 1992 this Court issued notice to\t the<br \/>\nrespondents  in\t this writ petition  returnable\t within\t six<br \/>\nweeks.\tA counter-affidavit has been filed on behalf of\t the<br \/>\nsecond\trespondent (State of Manipur) sworn to by  Shri\t Kh.<br \/>\nMohendro   Singh,  Joint  Secretary  (Home)  Government\t  of<br \/>\nManipur.   He has denied the several averments in  the\twrit<br \/>\npetition and has affirmed the version put forward in the FIR<br \/>\nas the true one.  Alongwith the counter-affidavit, copies of<br \/>\npostmortem reports relating to the said two deceased persons<br \/>\nare filed.\n<\/p>\n<p>4.   A rejoinder has been filed on behalf of the  petitioner<br \/>\ndenying\t  the  averments  in  the  counter   affidavit\t and<br \/>\nreiterating  the  statements  made  in\tthe  writ  petition.<br \/>\nAlongwith  the\trejoinder  some more  affidavits  have\tbeen<br \/>\nfiled.\n<\/p>\n<p>5.   It\t would\tbe evident from a perusal of  the  pleadings<br \/>\nthat  there is a serious dispute as to relevant facts.\t One<br \/>\nof  the\t aspects stressed by Shri Rajender  Sachar,  learned<br \/>\nsenior advocate for the petitioner is that according to\t the<br \/>\npostmortem  report  filed by the respondents, not  only\t the<br \/>\nentry  point  of  all  the bullets is in  the  back  of\t the<br \/>\ndeceased,  there is blackening, tattooing and  scrooting  in<br \/>\nrespect\t of  one of the bullet entry  points  pertaining  to<br \/>\nBeiklin.    The\t learned  counsel  submits  that  the\tsaid<br \/>\ncircumstance  supports the petitioner&#8217;s case that  the\tsaid<br \/>\ndeceased were shot from behind and at a close range.\n<\/p>\n<p>6.   The  learned  counsel  for\t the  respondent,   however,<br \/>\ndisputes the correctness of the said submission.\n<\/p>\n<p>7.   In view of the aforesaid two contradictory versions, we<br \/>\nthink  it appropriate in the facts and circumstances of\t the<br \/>\ncase  that  an enquiry is made by the learned  District\t and<br \/>\nSessions  Judge,  Churachandpur, State of Manipur  into\t the<br \/>\nsaid incident.\tThe learned District Judge shall record\t the<br \/>\nevidence  of the relevant witnesses and submit a  report  to<br \/>\nthis Court within six months.  To enable the teamed District<br \/>\nJudge to appreciate the facts of the case and also to enable<br \/>\nhim to identify the witnesses to be<br \/>\n<span class=\"hidden_text\">367<\/span><br \/>\nsummoned,  copies  of writ petition, counter  and  rejoinder<br \/>\nalongwith  the\tenclosed documents and affidavits  shall  be<br \/>\nforwarded to him.  The learned District Judge shall  examine<br \/>\nthe deponents of the said affidavits, if they are  available<br \/>\nand  willing to come forward to give evidence, And all\tsuch<br \/>\npersons\t as he thinks appropriate in the  circumstances\t and<br \/>\nmake his report.\n<\/p>\n<p>8.   It\t is obvious that before commencing the enquiry,\t die<br \/>\nlearned District Judge shall send notices to the petitioners<br \/>\nas well as the respondents.\n<\/p>\n<p>9.
