Case No. 2 of 2005 by learned<br \/>\nAdditional Sessions Judge, Surat, has been convicted for the offences<br \/>\nunder Section 20(b) and 29 of the Narcotic Drugs and Psychotropic<br \/>\nSubstances Act and sentenced to rigorous imprisonment for 10 years<br \/>\nfor both the aforesaid offences, has filed this Criminal<br \/>\nMiscellaneous Application praying for suspension of sentence and to<br \/>\nrelease him on bail during the pendency and final hearing of the<br \/>\nabove numbered Criminal Appeal.\n<\/p>\n<p>4.\t\tWe<br \/>\nhave considered the submissions advanced by Ms. Sadhana Sagar for the<br \/>\napplicant and Mr. Dabhi, learned APP for the respondent State of<br \/>\nGujarat. We have also perused the averments made in the application<br \/>\nso also the impugned judgement and order and the evidence.\n<\/p>\n<p>5.\t\tIt<br \/>\nmay be noted that this being successive bail application, no ground<br \/>\nis made out to persuade us to reconsider the prayer for bail. The<br \/>\ncontention that the applicant has undergone more than 50% of the<br \/>\ntenure of the total imprisonment is no ground to release the<br \/>\napplicant on bail. It is also required to be noted that the above<br \/>\nnumbered Criminal Appeal is listed for final hearing. In view of<br \/>\nthis, we are not inclined to suspend the sentence and release the<br \/>\napplicant on bail during the pendency and final hearing of the above<br \/>\nnumbered Criminal Appeal.\n<\/p>\n<p>6.\t\tSeen<br \/>\nin the above, the application lacks merit and it deserves to be<br \/>\nrejected.
