compensation of Rs.9.10,000I- forxthe death of  Shankare
\nGowda as he met with   fash\ufb02and negligent
\ndriving of the driver of a priiiate  3–3443. On<\/p>\n
the fateful_da$v’5on  deceased Shankare Gowda was
\nstandin\u00a7’2;y”the side  waitin for the bus. At that time,<\/p>\n
the driver  above taroceeding from Bangalore to Hassan.<\/p>\n
. i – drove the same in areal and negligent manner near Taiakere and<\/p>\n
   deceased. As a result, he sustained head<\/p>\n
 and shifted to NIMHANS where he succumbed to die<\/p>\n
 inju\ufb01esion 12.6.1995 at about 1.10 AM. i.e. within three hours after<\/p>\n
 ” the “accident.\n<\/p>\n
‘  4. The claimants by placing reliance on the avocation of the<\/p>\n
  -~–‘deceased Shankare Gowda that he was employed in Srigandha<\/p>\n
Kawal Junior College teaching Sericulture subjwt was paid a<\/p>\n
consolidated salary of Rs.’l,890l- subject to enhancementgand he<\/p>\n
would have got the said job being regularised and eavg<\/p>\n
earned salary on par with UGC scaie.\n<\/p>\n

5. On perusal of the notice  sogfar as the
\nrash and negiigent driviragef   busla criminal case
\nwas registered against meggdrieeri  ‘and.a\ufb01er investigation.
\nhe was charge””;sheete_d  V punishable under
\nSections.27i9:.’V   The claimant was not
\nthe Encidenebut the Police records. especially the
\nspot panchainama’-at  the fact of dte driver of me<\/p>\n
bue\u00e9eoming to tne__e’xtrerrie left side of the road onto the kacha road<\/p>\n
‘  and e~a.gainst”the deceased causing fatal injuries. Even<\/p>\n
   of the Tribunal need not be altered having<\/p>\n
regard  rnaterial i.e. die Police records that were placed<\/p>\n
i before” the Tribunal.\n<\/p>\n
” *   6.”l”hen ccrning to the question of quantum of compensation.<\/p>\n
 the date of his death. he was aged about 35 years and his<\/p>\n
  of em as per SSLC certi\ufb01cate was 10.9.1959. The<\/p>\n
deceased had completed M.Sc degree in Botany and was teaching<\/p>\n
Seriouiture subject as a temporary Lecturer on a consolidated<\/p>\n
remuneration of Rs.1.890I-. PW.2 was examined to speak. the<\/p>\n
detaiis of the work of the deceased and aiso the <\/p>\n
to disciose the fact that in piece of deceased  <\/p>\n
someone else is recruited and whatiiisthe ‘aaieryi:paid,vvVto” the<\/p>\n
subsequent Lecturer whose service v1vasi’r.ezguiarised”in=the\\’year~,<\/p>\n
2000.\n<\/p>\n
‘2’. The evidence of  rdeeumentary material on
\nrecord disclose th’e,t__ one”‘S’rini\u00a7ragaWlyurttiyziriiirlras recruited as a
\ntemporary Lectureriiigiriplace deceased Shankare Gowda after the
\ndeath er snarlyke:er\u00ab..eieed<er'f'i'iir 1995. The said subject had so
\nstudentsand poet"oi  illlurthy has been made permanent<\/p>\n
(reguiarised)  'tiielyearx\ufb01oeo. Ex.P.25 is produced to show that<\/p>\n
.""eloVn'gV.  Tisritrjivasafllililurtiiy, other Lecturers like Ravishankar,<\/p>\n
 Fytajeeheiraryyvand-liriamechandra were also appointed on permanent<\/p>\n
basis. v_.~F?ari:uaohandra and Rajashekar were also teaching<\/p>\n
"–Sericulture subject. 'i'he salary of these Lecturers after<\/p>\n
"_Areg1ilarisation w.e.f. 1.11.2000 as per Ex.P.25 is 6000~i5G-7200\u00bb<\/p>\n
it  2oom26o–1oeao.32o–112oo. By the time he retired from<\/p>\n
'4 service, his Basic Pay would have been Rs.11,20G9!- apart from<\/p>\n
DA, HRA and other perks. which were aliowed to his post.<\/p>\n
8. The ques\ufb01on is, whether \ufb01ne deceased Shanicare Gowda<\/p>\n
would have earned the said salary of Rs.11,200I- as on ihe,:.ol’ate of<\/p>\n
his retirement. The material on record amply {act<\/p>\n
that in the normal course of events. this Shankarev:”\u20ac\u00a7ov\u00a2r:la ibu’tl’fcr_  <\/p>\n
