  in the Primary Health Centre, Matta<\/p>\n
Netvila’-I:i r1’Channarayapatna taluk, was issued a Charge<\/p>\n
 ‘Iiiemevtttalleging that Ceztain aliowa\u00e9aces in respect Of<\/p>\n
family planning operation not being paid to the<\/p>\n
beneficiaries and also other charges such as maternity<\/p>\n
allowances not being paid properly and <\/p>\n
was working as a medical officer he ha_d..notvdilsbu1’se’d.V <\/p>\n
allowance to 17 persons W]’10:;bAha:V”4\u20acp’A<\/p>\n
planning surgery. An enquiry wals.__initiat.e’d  tlregtv<\/p>\n
respondents and one Guriich_ann–abasappa;. The
\nenquiry officer conclude-:1 that;_th”e–..charge that maternity
\nallowance had A not been._ paid’  ” Sorekayipurada<\/p>\n
Bhagramrnal-I   11:?’ been proved.\n<\/p>\n
Thereafter”a..sinoW5’cau’se:’ notice Wasi issued to the<\/p>\n
respondent V –andf~._ll'”subsequently punishment of<\/p>\n
withholding’ _five,..’-annual increments with cumulative<\/p>\n
  was “in1poseVd;””With regard to enquiry held against<\/p>\n
.’_Guruech’aniiabasappa punishment of censure was<\/p>\n
in1p.ose_d.~  respondent herein being aggrieved by the<\/p>\n
 imposition of punishment, challenged the same<\/p>\n
  before the Tribunai. The Tribunal on consideration of<\/p>\n

\nnot been conducted in accordance with law and that the<\/p>\n
evidence on the basis of which the charges were<\/p>\n
have been proved was only hearsay evidence<\/p>\n

 Officer on the basis of the statement<\/p>\n
reco__rdeci~in.~’ the said enquiry, disciplinary proceedings<\/p>\n
were initiated and that there was sufficient material on<\/p>\n
record for imposition of the penalty, but the Tribunal<\/p>\n
has failed to appreciate this aspect of<\/p>\n
Therefore, she contends that the order..of,.A4_theribunai. <\/p>\n
has to be set aside and the pun_ishm.ent.’iniposed<\/p>\n
be confirmed in this Writ Petitioni’  <\/p>\n
5. Per contra\u00ab,_.’v1:i’eari\ufb011ec:ip’counsel appearing for the
\nrespondent su,pporting’v\u00bbt1f1eVorderifdvof Tribunal has
\nsubmitted   _en_tire_\u00ab–  was based on
\ninsuff”1ci’en’t    \u00bb   V  on hearsay evidence.
\nTherefc-re,\u00ab.the~  justified in setting aside the<\/p>\n
punvishment andV’.order”‘c1oes not call for any interference<\/p>\n
  Petition. He further submitted that the<\/p>\n
 ready to face any fresh enquiry, if<\/p>\n
initiated~hy..-the Authorities concerned.

6. Having heard the learned counsel on both<\/p>\n
sides and on perusal of the material on recordgit is<\/p>\n
noticed that the charges leveled against <\/p>\n
were with regard to the non Mpaymeni.”v–o:f~..<\/p>\n
allowance to one Smt. Sorekayipur:ad.\u00e9;  and<\/p>\n
non payment of family plazining allovvancelvtofuji~7,pe.rsons. L’<\/p>\n
and other incidental chargesly-..ifihoughl  preliminary
\nenquiry was conductedand.  recorded in
\nthe disciplinarye_nquiry’iriitia’Led_on’. lhlasis of the said
\ncharges,    ll  not received the
\namouvntslw\ufb01vigyv  on the other hand, the
\nOfficelr\ufb01vlrhol  the preliminary enquiry<\/p>\n
stated that-~o_n the basis” of the statements made to him<\/p>\n
letitingllliriwthe evidence. The Tribunal rightly<\/p>\n
   the said evidence of the Officer was only<\/p>\n
hearsay ~e_vi.s:ilence and was not sufficient to come to the<\/p>\n
 conclusion either that the amount was not paid to Smt.<\/p>\n
 Sorelkayipurada Bhagyamma or to other seventeen<\/p>\n
is.\n<\/p>\n

beneficiaries. In fact, none of the beneficiaries were<\/p>\n
examined so as to prove that they have not received the<\/p>\n
said amounts. In the circumstances, the ‘Ifri’b11u11al5i_1a~s<\/p>\n
rightly held that the finding arrived? at <\/p>\n
authority and the punishniient-..ifp.in’ipyo’sed-  <\/p>\n
disciplinary authority were u_nsus’t.ainable'”aridguashed:*<\/p>\n
the same. We are in confiriniiy with the reasoning
\ngiven by the Tribu~nial_A ‘i_na:jsm’ucih_'”~as the requisite
\nmaterial evidence of the’bene’ficiarie_s more not let in and<\/p>\n
hence, based  hearsay evid;e_nce,m”punishment could
\nnot have   Hovvever, since the Tribunal
\nhas merely qL1.aslje.d”th’e\u00ab.order of punishment without<\/p>\n
anypyfurther’direction;  deem it proper, while affirming<\/p>\n
 ‘order  the ribunal to reserve liberty to the State<\/p>\n
