DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 98\/2010 with Olpad Police Station for the offences<br \/>\n\tpunishable under Sections 406, 420, 423, 465, 467, 468, 471, 120-B,<br \/>\n\t114 etc. of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicant submits that the applicant is falsely<br \/>\n\timplicated in the crime and co-accused is granted anticipatory bail.<br \/>\n\t He further submitted that the applicant has put his signature in<br \/>\n\tthe document and has neither received any money nor made any false<br \/>\n\trepresentation.  He further submitted that considering the facts and<br \/>\n\tcircumstances of the case, the applicant deserves to be granted<br \/>\n\tanticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tLearned APP for the respondent &#8211; State.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel for the parties and perused the record of the case.<br \/>\n\tTaking into consideration the totality of the facts and<br \/>\n\tcircumstances of the, including the facts that  and considering the<br \/>\n\tfacts that co-accused is granted anticipatory bail and prima facie<br \/>\n\tthe applicant has put his signature in the document and has neither<br \/>\n\treceived any money nor made any false representation, I am inclined<br \/>\n\tto grant anticipatory bail to the applicant.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tCR No.I 98\/2010 registered with Olpad Police Station,  the applicant<br \/>\n\tshall be released on bail on furnishing a bond of Rs.5,000\/- (Rupees<br \/>\n\tFive Thousand only) with one surety of like amount on following<br \/>\n\tconditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 30.11.2010 at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>With<br \/>\n\tthese directions, this Criminal Misc.
