COURT MADE THE FOLLOWTING:\n<\/p>\n
0 R D E R<\/p>\n
The petitioner, who had been employed the
\nMysore City Corporation way back in the year,
\n12-3-1982 on the basis of the qulalification in
\nelectrical engineering as junior  it
\nfortuitous promotion on 13-\n<\/p>\n
engineer [AEE], thougil*b_y  hehadvvremained
\na diploma holderin  <\/p>\n
2. Perlrapisgjglothier  the post holding better<\/p>\n
qualifications’  “got agitated and could have<\/p>\n
represeritedkto’  Aeinployer but more importantly, the<\/p>\n
 for such—-\u00ab’promotion being solicited by the<\/p>\n
  government, which is the Controlling<\/p>\n
antlfllority,loi{_cr all municipal corporations, did not \ufb01nd<\/p>\n
ll”>~’..__”-favour”  according such promotion and therefore, the<\/p>\n
   in terms of the order dated 29-7-2002 [[copy at<\/p>\n
   _gAnnexure–A to the writ petition], reverted the petitioner to<\/p>\n
it the post of JE in the pay scale as is admitted to the said<\/p>\n
M<\/p>\n
post. It is aggrieved by this order, the present Writ<\/p>\n
petition.\n<\/p>\n
3. After issue of notices, the respondents—- entered.
\nappearance through counsel. Straternentiofiiflas<\/p>\n

4. I have heard   for the
\npetitioner and Ms Geevthavii.’}’e’ai*ned counsel for
\nthe second  and Sri
\n Advocate for the<\/p>\n

5. Subrnission  S Naik, learned counsel for the<\/p>\n
 p_ petiti*oner,  that\u00abthe.’emp1oyer is not justified in reverting<\/p>\n
  -.pgetitiorre:r+employee to the earlier post, as in the<\/p>\n
‘hand recruitment rules to hold the post of ABE, particularly
\nA  irequirernent of securing degree in engineering, the
\n  en\ufb01iployer is not justified in passing an order adverse to the<\/p>\n
it interest of the employee and therefore the impugned order<\/p>\n
absence oi’ quali\ufb01cation prescribed under the cadre<\/p>\n

required to be quashed and the earlier order, promoting<\/p>\n
the petitioner be sustained.\n<\/p>\n

7. That apart, learned counsel for the respondent-
\ncorporation further submits that the corporation having
\ncategorized persons holding the post of junior engineer
\ninto two categories viz., grade} and grade–II, on
\nthe number of years of experience
\npersons promoted from grade~I  it
\nbeing so promoted from
\npetitioner, at the time of effecting thevtproniotiton\ufb02being in
\ngrade~iI category, 1. tath\u00e9 petitioner
\nhaving been found  earmarked for<\/p>\n
and realized that it was a
\nmistake” to so him in the year 1995, the<\/p>\n
corporation” has-.”so1d1ght to correct this mistake and<\/p>\n

\n  the cadre and recruitment rules are binding on persons in<\/p>\n

having not prescribed degree being the quali\ufb01cation, the

  seniority in the cadre of AER from the date on which the<\/p>\n
vacancy in the post of AEE opened for the junior engineers<\/p>\n
in the category of grade–II.\n<\/p>\n
