Both the counsels have jointly<br \/>\n\trequested that both these matters can be heard and disposed of<br \/>\n\tfinally by this common judgment as the parties are the same and the<br \/>\n\tsame award is impugned in both the petitions.\n<\/p>\n<p>So<br \/>\n\tfar as Special Civil Application No.6972 of 2008 is concerned, which<br \/>\n\tis filed by the workman petitioner, challenging the award dated<br \/>\n\t29-2-2008 passed by the Presiding Officer, Labour Court, Bharuch, in<br \/>\n\tReference (LCB) No.330 of 1998 to the extent that it did not grant<br \/>\n\trelief of reinstatement and back wages despite recording finding<br \/>\n\tthat the termination of the petitioner was not in accordance with<br \/>\n\tlaw.\n<\/p>\n<p>Special<br \/>\n\tCivil Application No.11493 of 2008 is filed by the employer<br \/>\n\tchallenging the finding and award dated 29-2-2008 with regard to<br \/>\n\ttermination on the ground that Labour Court ought to have rejected<br \/>\n\tthe same.\n<\/p>\n<p>Mr.Mishra<br \/>\n\tfor the workman contended that when Labour Court has recorded the<br \/>\n\tconclusion that termination of the workman was not strictly in<br \/>\n\taccordance with law, despite that erroensouly did not grant<br \/>\n\tappropriate relief of reinstatement with full back wages. Mr.Mishra<br \/>\n\thas taken this Court through the observations of Labour Court and<br \/>\n\tcontended that merely recording of finding that the workman earning<br \/>\n\tRs.4,800\/= in a private firm and time gap of termination till the<br \/>\n\taward in itself would not prevent granting appropriate relief in<br \/>\n\tsuch a case.\n<\/p>\n<p>This<br \/>\n\tCourt has heard learned counsels for the parties and perused papers.<br \/>\n\t The finding which deserves to be considered by this Court and which<br \/>\n\thas remained unchallenged by either side, is that the workman has<br \/>\n\tbeen earning Rs.4,800=00 per month in other firm and there is time<br \/>\n\tgap from the date of termination till the date of order and<br \/>\n\tespecially when the workman had put in only two years of service in<br \/>\n\trespondent-company. The incident of strike has also been mentioned<br \/>\n\twhich is at the behest of the concerned workman. Labour Court has<br \/>\n\talso recorded that the charges levelled against the workman can be<br \/>\n\tsaid not proved only on account of lack of evidence and looking to<br \/>\n\tthe strained relationship between the parties, Labour Court has<br \/>\n\tawarded merely compensation. This Court is of the view that the same<br \/>\n\tcannot be said to be reasonable calling for interference by this<br \/>\n\tCourt.  Learned counsel for the employer in Special Civil Applcation<br \/>\n\tNo.11493 of 2008 also could not point out any cogent reason for<br \/>\n\tinterference with the finding of the Labour Court which is recorded<br \/>\n\tafter perusing evidence available on record.\n<\/p>\n<p>In<br \/>\n\tview of this, both the applications deserve to be dismissed and<br \/>\n\taccordingly dismissed.  However, there shall be no order as to<br \/>\n\tcosts.
