SHAH\n\t\t\n\t\n\n \n\nDate\n: 02\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent Special Criminal Application under Article 226 of the<br \/>\nConstitution of India has been preferred by the petitioners for an<br \/>\nappropriate writ, order or direction quashing and setting aside the<br \/>\nimpugned communication dated 09\/05\/2011 and consequently direct the<br \/>\nrespondents to grant police protection\/security or police bandobast<br \/>\nto the petitioners for a period of 30 days.\n<\/p>\n<p>2.\tIt<br \/>\nappears that as the petitioners were apprehending breach of law and<br \/>\norder by the persons named in the application dated 16\/06\/2011, they<br \/>\nrequested for police protection\/police bandobast while putting up<br \/>\nconstruction of compound wall  and vide impugned communication the<br \/>\nsame has been rejected by  the office of the Commissioner of Police,<br \/>\nSurat on the ground that there is a Court case pending.\n<\/p>\n<p>3.\tShri<br \/>\nKapadia, learned advocate appearing on behalf of the petitioners has<br \/>\nsubmitted that as such no Court case is pending and still the<br \/>\napplication of the petitioners for police bandobast has been rejected<br \/>\nby the office of the Commissioner of Police, Surat.\n<\/p>\n<p>4.\tOn<br \/>\nan advance copy of the petition being served upon the learned APP,<br \/>\nShri K.P. Raval, has appeared on behalf of the respondents and under<br \/>\ninstructions from the concerned respondents has candidly admitted<br \/>\nthat as such no Court case is pending except the proceedings under<br \/>\nSection 145 of the Code of Criminal Procedure. He has also stated at<br \/>\nthe bar, under instructions from the concerned respondents, that<br \/>\npolice protection\/police bandobast can be granted to the petitioners<br \/>\nat their own cost and number of Police Officers required shall be<br \/>\ndecided by the office of the Commissioner of Police, Surat and the<br \/>\nsame shall be informed to the petitioners within a period of one week<br \/>\nfrom the date of receipt of the present order alongwith the<br \/>\nexpenditure for the same.  On such deposit, if there is no<br \/>\nprohibitory order passed by any Court, police protection\/police<br \/>\nbandobast can be given to the petitioners as and when the petitioners<br \/>\npropose to put up the compound wall with prior intimation in advance.\n<\/p>\n<p>4.1.\tConcerned<br \/>\nrespondents are directed to act as stated hereinabove and consider<br \/>\nthe request of the petitioners for grant of police protection\/police<br \/>\nbandobast as and when they propose to put up the compound wall around<br \/>\ntheir own land, with prior intimation and at their own cost and<br \/>\nnumber of Police Officers required for police protection\/police<br \/>\nbandobast shall be decided by the Commissioner of Police, Surat<br \/>\nwithin a period of one week from the date of receipt of the present<br \/>\norder and the petitioners shall also be intimated the approximate<br \/>\nexpenditure for the same and on such deposit the prayer of the<br \/>\npetitioners for police protection\/police bandobast be considered.
