Learned Additional<br \/>\nPublic Prosecutor Miss Mita Panchal appearing on behalf  of the State<br \/>\nand learned advocate Mr. B.N. Patel  appearing on behalf of the<br \/>\ncomplainant are  heard  for the appellant  and  learned  senior<br \/>\nadvocate Mr. M.R. Barot  with learned advocate Mr. Y.V. Brahmbhatt<br \/>\nare heard  for the respondents.\n<\/p>\n<p>2.\t\tIt<br \/>\nmay be mentioned here that we have been informed that the parties<br \/>\nhave  reached  a broad agreement  in between them and with the<br \/>\nfeeling of forget and forgive,  the matters are sought to be<br \/>\nreconciled.\n<\/p>\n<p>3.\t\tThe<br \/>\nappeal is abated against those  respondent Nos. 1,3,4,8 and 12 of<br \/>\nCriminal Appeal No.1425 of  1986   who have  died  during the<br \/>\npendency of appeal.  Death certificates  are  produced by the learned<br \/>\nAdditional Public Prosecutor.\n<\/p>\n<p>4.\t\tThe<br \/>\nappeal preferred  against the order of acquittal, being  Criminal<br \/>\nAppeal No.1425 of  1986, is hereby dismissed,  as there is no merit<br \/>\nin the appeal and no good  and cogent  reasons  are  shown  and<br \/>\nthere is no any illegality  committed by the learned Sessions Judge,<br \/>\nfor interference in the judgment  and order passed by the learned<br \/>\nSessions Judge.\n<\/p>\n<p>5.\t\tThe<br \/>\nappeal preferred for enhancement, being  Criminal Appeal No.1424 of<br \/>\n1986, is also  dismissed with a modification that, to maintain<br \/>\nharmony, peace and good relations  between the parties, the four<br \/>\nconvicted  respondent  Nos. 1,4,5 and 6 of Criminal Appeal No.1424 of<br \/>\n1986  each  will pay  Rs.25,000\/- (Rupees  Twenty five  thousand<br \/>\nonly)  to the complainant side, i.e.  heirs of the deceased,  through<br \/>\n elder son Kanjibhai, son of  Mavjibhai Karamshibhai Chaudhary, on or<br \/>\nbefore  05.10.2008, as agreed by them.\n<\/p>\n<p>6.\t\tBail<br \/>\nbonds of the respondents accused are hereby ordered  to be<br \/>\ncancelled.
