Ultimately, the disciplinary<br \/>\nauthority imposed the punishment of stoppage of one increment without<br \/>\ncumulative effect, vide order dated 30.08.1994. The higher authority<br \/>\nof the petitioner-Corporation reviewed the said order of penalty and<br \/>\nthereafter, enhanced it to stoppage of three increments with<br \/>\npermanent effect. The second appeal filed before the appellate<br \/>\nauthority against the said order came to be rejected.\n<\/p>\n<p>3.\tBeing<br \/>\naggrieved by the same, the respondent raised a dispute, which was<br \/>\nreferred to the Industrial Tribunal, Vadodara for adjudication. The<br \/>\nTribunal, after hearing both the sides, partly allowed the reference<br \/>\nby modifying the punishment by way of the impugned award. Hence, this<br \/>\npetition.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The respondent was found guilty of serious irregularity \/<br \/>\nmisconduct on twelve (12) different occasions in the past. The<br \/>\nmisconduct for which the respondent was charge-sheeted is very<br \/>\nserious in nature. The respondent appears to be a habitual defaulter<br \/>\nsince he had not improved his beahviour though several opportunities<br \/>\nwere granted to him.\n<\/p>\n<p>5.\tLooking<br \/>\nto the facts of the case and the past record of the respondent, I am<br \/>\nof the opinion that the penalty imposed by the Tribunal is on the<br \/>\nlesser side. In my opinion, if the penalty of stoppage of Two<br \/>\nIncrements with future effect is imposed on the respondent, the same<br \/>\nwould meet with the ends of justice. Orders accordingly. The impugned<br \/>\naward stands modified accordingly. This order to be implemented<br \/>\nwithin a period of six months from today. The petition stands<br \/>\ndisposed of accordingly. Rule is made absolute to the above extent<br \/>\nwith no order as to costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
