Justice ANTONY DOMINIC\n\n Dated :27\/09\/2010\n\n O R D E R\n                     ANTONY DOMINIC, J.\n\n           ```````````````````````````````````````````````````````\n               W.P.(C) No. 29673 of 2010 H\n           ```````````````````````````````````````````````````````\n           Dated this the 27th day of September, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>          Challenge in this writ petition is against Exts.P3<\/p>\n<p>and P4. Petitioner applied for mining permit for the removal of<\/p>\n<p>clay.    Though,      by     Ext.P1       report      of    the   Geologist,<\/p>\n<p>recommendation was made for grant of the permit, it is stated<\/p>\n<p>that request of the petitioner was finally rejected. Appeal was<\/p>\n<p>filed before the Government.              That was also rejected by<\/p>\n<p>Ext.P3 order. Petitioner filed another appeal against Ext.P3<\/p>\n<p>before the Government, which was also rejected by Ext.P4<\/p>\n<p>order dated 05-06-2010. Petitioner sought for reconsideration<\/p>\n<p>of the matter by filing Exts.P5 and P6.                     There was no<\/p>\n<p>response and at this stage, this writ petition was filed.<\/p>\n<p>      2.  Reason stated in Ext.P4 is contained in paragraph<\/p>\n<p>5, which reads as under:-\n<\/p>\n<blockquote><p>                 &#8221; 5. The petitioner and his counsel<\/p>\n<p>           were again heard on 19-05-2010. The matter<\/p>\n<p>           was examined in detail after taking into<\/p>\n<p>WPC.29673\/10<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>           account the contentions of both parties. On<\/p>\n<p>           the basis of the directions given to the<\/p>\n<p>           Director of Mining &amp; Geology a field<\/p>\n<p>           inspection was carried out by Sri.D.P.<\/p><\/blockquote>\n<p>           Sreekumar, Senior Geologist on 05-04-2010<\/p>\n<p>           in the averred area. During the inspection,<\/p>\n<p>           the Geologist and Assistant Geologist of the<\/p>\n<p>           District Office, Kollam and Special Village<\/p>\n<p>           Officer concerned were also present. In the<\/p>\n<p>           report furnished by Sri.D.P.Sreekumar, Senior<\/p>\n<p>           Geologist it is stated that the averred area is<\/p>\n<p>           situated on the bank of Kallada river and<\/p>\n<p>           forms a part of the flood plain. The appellant<\/p>\n<p>           had already extracted brick clay from the<\/p>\n<p>           averred area on the strength of the Quarrying<\/p>\n<p>           Permits issued from the Geologist, District<\/p>\n<p>           Office, Kollam during the year 2002-03. Due<\/p>\n<p>           to the above extraction the surface level of the<\/p>\n<p>           averred area and the surrounding area has<\/p>\n<p>           come down and also due to mining activities,<\/p>\n<p>           most of the adjoining areas has become water<\/p>\n<p>           logged, even during the month of April. It is<\/p>\n<p>           also reported that the entire area has already<\/p>\n<p>           become environmentally fragile and further<\/p>\n<p>WPC.29673\/10<br \/>\n<span class=\"hidden_text\">                                  : 3 :<\/span><\/p>\n<p>             mining in the area can accelerate the flooding<\/p>\n<p>             of the entire area and there could be a drift in<\/p>\n<p>             the course of the river. The Senior Geologist<\/p>\n<p>             opined that since mining activity is likely to<\/p>\n<p>             cause severe environmental degradation, it<\/p>\n<p>             would be advisable to abstain from any such<\/p>\n<p>             further mining activities in the averred area<\/p>\n<p>             which would lead to severe environmental<\/p>\n<p>             impact such as flooding, change of river<\/p>\n<p>             course etc. Moreover the consent given by the<\/p>\n<p>             Secretary, State Pollution Control Board also<\/p>\n<p>             expired on 30-06-2009 and no further consent<\/p>\n<p>             for mining has been given by the Pollution<\/p>\n<p>             Control Board since 30-06-2009.&#8221;\n<\/p>\n<p>       3.   A perusal of the above shows that it was only<\/p>\n<p>because of the environmental impact and for other relevant<\/p>\n<p>consideration that the mining permit sought for by the<\/p>\n<p>petitioner was rejected. There is nothing to show that the<\/p>\n<p>reasons contained in Ext.P4 are arbitrary or are vitiated for<\/p>\n<p>malafides.     In such circumstances, this Court will not be<\/p>\n<p>justified in upsetting the said order.<\/p>\n<p>WPC.29673\/10<br \/>\n<span class=\"hidden_text\">                                : 4 :<\/span><\/p>\n<p>     4.    However, petitioner has a case that mining is<\/p>\n<p>permitted in the neighbouring properties and, therefore, he<\/p>\n<p>alone could not have been discriminated.             Even if the<\/p>\n<p>submission that mining is permitted in the neighbouring<\/p>\n<p>properties is factually correct, there is no material to conclude<\/p>\n<p>that those properties are similar in all respects. That apart,<\/p>\n<p>even if wrong permits are granted to other properties, there is<\/p>\n<p>no justification for the prayer made before this Court to order<\/p>\n<p>grant of permit to the petitioner.
