Justice M.SASIDHARAN NAMBIAR\n\n Dated :04\/01\/2007\n\n O R D E R\n                    M.SASIDHARAN NAMBIAR, J.\n\n        ...........................................\n\n                       C.R.P No.15 OF 2007\n\n       ............................................\n\n          DATED THIS THE 4TH DAY OF JANUARY, 2007\n\n\n\n                                ORDER\n<\/pre>\n<p>     E.P.507   of   2005   on   the   file   of   Munsiff   Court,<\/p>\n<p>Ernakulam   was   filed   by   respondents   1   to   3   being   the<\/p>\n<p>legal   heirs   of   deceased   Velu,   the   decree   holder   in<\/p>\n<p>O.S.1899   of   1997   for   delivery   of   the   property   as<\/p>\n<p>provided   under   the   decree.   Petitioner   filed   E.A.268   of<\/p>\n<p>2006 contending that she is the widow of deceased Velu<\/p>\n<p>and first respondent is not his wife and respondents 2<\/p>\n<p>and   3   are   not   the   children     of   Velu   and   therefore<\/p>\n<p>respondents 1 to 3 are not entitled to take delivery of<\/p>\n<p>the property and petitioner is to be impleaded.\n<\/p>\n<p>Respondents 1 to 3 opposed the application. The learned<\/p>\n<p>Munsiff   under   order   dated   23.11.2006   dismissed   the<\/p>\n<p>application filed by the petitioner which is challenged<\/p>\n<p>in   this   revision   petition   filed   under   Section   115   of<\/p>\n<p>Code of Civil Procedure.\n<\/p>\n<p>     2.   Learned   counsel   appearing   for   the   petitioner<\/p>\n<p>vehemently   argued   that   respondents   1   to   3   are   total<\/p>\n<p>strangers   and   they   have   nothing   to   do   with   deceased<\/p>\n<p>Velu   and   petitioner   is   the   widow   of   Velu   and   she   has<\/p>\n<p><span class=\"hidden_text\">CRP 15\/2007                        2<\/span><\/p>\n<p>produced   Ext.A1   marriage   certificate   obtained   from   the<\/p>\n<p>temple   to   establish   their   marriage   and   in   such<\/p>\n<p>circumstances,   the   learned   Munsiff   should   have   allowed<\/p>\n<p>petitioner   to   get   herself   impleaded   in   the   execution<\/p>\n<p>petition.\n<\/p>\n<p>     3.   The   impugned   order   passed   by   the   learned<\/p>\n<p>Munsiff   shows   that   the   respondents   1   to   3   produced<\/p>\n<p>Ext.P2   legal  heir  certificate  issued  by  the    Tahsildar<\/p>\n<p>to   prove   that   first   respondent   is   the   widow   and<\/p>\n<p>respondents 2 and 3 are the children of deceased Velu.\n<\/p>\n<p>So   also   Ext.P1   identity   card   and   Ext.B3   certificate<\/p>\n<p>issued by the Village Officer and Ext.B4 order from the<\/p>\n<p>local   administration   department   and   Exts.B5   and   B8<\/p>\n<p>orders were produced. In the light of Exts.B1 to B6 the<\/p>\n<p>learned   Munsiff   found   that   respondents   1   to   3   are   the<\/p>\n<p>legal heirs of the deceased Velu and petitioner is not<\/p>\n<p>entitled   to   get   herself   impleaded.   I   do   not   find   any<\/p>\n<p>illegality  or irregularity  in that order in the light<\/p>\n<p>of   the   docments   produced   by   respondents   1   to   3.\n<\/p>\n<p>Petitioner   is   at   liberty   to   file   a   separate   suit<\/p>\n<p>establishing   her   right   as   the   widow   and   if   petitioner<\/p>\n<p>could   establish  that  right,  the  delivery  in  E.P.507  of<\/p>\n<p><span class=\"hidden_text\">CRP 15\/2007                        3<\/span><\/p>\n<p>2005 made by the court in favour of respondents 1 to 3<\/p>\n<p>shall   enure   to   the   benefit   of   the   real   legal   heir   of<\/p>\n<p>the deceased Velu.\n<\/p>\n<p>                                   M.SASIDHARAN NAMBIAR, JUDGE<\/p>\n<p>lgk\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Maina vs Avadi Ammal on 4 January, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM CRP No. 15 of 2007() 1.
