Nanavaty waives service of notice of Rule for<br \/>\n\tthe respondent &#8211; State.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate for the applicant Mr. H.R. Prajapati submits that in view<br \/>\n\tof nature of his job assignment as a Tour Manager, the applicant has<br \/>\n\tto travel to various places in the country and his job as above is<br \/>\n\tthe only source of livelihood for him and his family.   Hence, the<br \/>\n\tother conditions imposed vide order dated 27.09.2011 passed in<br \/>\n\tCriminal Miscellaneous Application No.12143\/2011 will be sufficient<br \/>\n\tto secure his presence during trial.\n<\/p>\n<p>Considering<br \/>\n\tthe above, I am inclined to delete conditions Nos.[d] and [e] of the<br \/>\n\torder dated 27.09.2011 passed in Criminal Miscellaneous Application<br \/>\n\tNo.12143\/2011, keeping the other conditions as they are.  However,<br \/>\n\tas and when the presence of the petitioner is required by the<br \/>\n\tconcerned Court, he shall remain present unless so exempted.\n<\/p>\n<p>With<br \/>\n\tthe aforesaid observation and direction, this application stands<br \/>\n\tallowed to the aforesaid extent.
