{"id":65797,"date":"2008-07-17T00:00:00","date_gmt":"2008-07-16T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-prem-singh-vs-department-of-personnel-on-17-july-2008"},"modified":"2018-09-16T21:47:11","modified_gmt":"2018-09-16T16:17:11","slug":"shri-prem-singh-vs-department-of-personnel-on-17-july-2008","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-prem-singh-vs-department-of-personnel-on-17-july-2008","title":{"rendered":"Shri Prem Singh vs Department Of Personnel &amp; &#8230; on 17 July, 2008"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Prem Singh vs Department Of Personnel &amp; &#8230; on 17 July, 2008<\/div>\n<pre>                 CENTRAL INFORMATION COMMISSION\n                   Appeal No. CIC\/WB\/C\/2007\/00729 dated 18-5-2007\n                     Right to Information Act 2005 - Section 19\n\nAppellant:            Shri Prem Singh\nRespondent:           Department of Personnel &amp; Training (DOPT)\n                      Ministry of Personnel, Public Grievances &amp; Pensions\n\nFACTS<\/pre>\n<p>         By an application of 5-9-06 received in the DoPT on 13-9-06 Shri Prem<br \/>\nSingh of Hqrs. of 14 Border Road Task Force applied to the CPIO, DoPT<br \/>\nseeking the following information:\n<\/p>\n<p>   (a)      Certified true copy of policy\/ guidelines framed by the Govt.\n<\/p>\n<p>            of India for acceding to the eligibility\/ criteria of any Central<br \/>\n            Organization as security or intelligence organization for the<br \/>\n            purpose of inclusion in the second schedule to the Right to<br \/>\n            Information Act, 2005.\n<\/p>\n<p>   (b)      Certified true copy of noting sheet of the Department of Pers<br \/>\n            and Trg where it has been decided by the competent<br \/>\n            authority that the Border Roads Development Board (BRDB)<br \/>\n            should be included in the second schedule to the RTI Act,<br \/>\n            2005.\n<\/p>\n<p>   (c)      Reasons for not including the Border Roads Development<br \/>\n            Board (BRDB) in the second schedule to RTI Bill, 2005<br \/>\n            which was drafted by the Union Ministry of Personnel, Public<br \/>\n            Grievances and Pensions and introduced in the both houses<br \/>\n            of Parliament for debate.\n<\/p>\n<p>   (d)      Provide the copy of memorandum of Union Ministry of<br \/>\n            Personnel, Public Grievances and Pensions issued to all the<br \/>\n            Ministries\/ Department for submitting their report to include<br \/>\n            the Department\/ Office under second schedule of RTI Bill,<br \/>\n            2005 and also provide the copy of report submitted by BRDB<br \/>\n            for inclusion in second schedule of the RTI Bill 2005.\n<\/p>\n<p>   (e)      Reason for not including the Border Roads Development<br \/>\n            Board (BRDB) in the schedule to the Freedom of Information<br \/>\n            Act, 2002 which was remain in force for near about two years<br \/>\n            and six months i.e. from 06th Jan 2003 to 14th June 2005.&#8221;\n<\/p>\n<p>         To this he received a response on 9-10-06 from CPIO, Shri P.K. Mishra,<br \/>\nUS, DoPT stating as follows:\n<\/p>\n<p><span class=\"hidden_text\">                                          1<\/span><\/p>\n<blockquote><p>          &#8220;I am to inform you that the Border Roads Development Board<br \/>\n         (BRDB) has been included in the second Schedule to the Right<br \/>\n         to Information Act, 2005 vide this Department&#8217;s Notification No.<br \/>\n         34012\/12(S)\/2005- Estt. (B) dated 28th September 2005.<br \/>\n         Section 24 of the Act provides that provisions of the Act shall not<br \/>\n         apply to the Intelligence and security organizations specified in<br \/>\n         the second schedule or any information furnished by such<br \/>\n         organizations to the Central Government. However, the<br \/>\n         information pertaining to allegations or corruption and human<br \/>\n         rights violations shall not be excluded under Section 24.&#8221;<\/p><\/blockquote>\n<p>         Not satisfied with this response Shri Prem Singh moved his first appeal<br \/>\nbefore Shri K.G. Verma, DS, DoPT on 20-12-06 pleading that the information<br \/>\nsought was not under the category of classified record or documents nor<br \/>\nexempted from the disclosure u\/s 8 (1) and should therefore, be provided. On<br \/>\nnot receiving a response Shri Prem Singh moved second appeal before us<br \/>\nwith the following prayer:\n<\/p>\n<p>   (a)      The entire matter of including BRDB in the second schedule<br \/>\n            of RTI Act may please be investigated to justify the<br \/>\n            correctness of the same under the provision of RTI Act and<br \/>\n            policy guidelines framed by parliament\/ govt. of India to<br \/>\n            include other organization and intelligence and security<br \/>\n            organization in the second schedule through notification at<br \/>\n            later stage.\n<\/p>\n<p>   (b)      Also direct Shri P. K. Mishra, PIO Dep&#8217;t of Pers and      New<br \/>\n            Delhi-01 to provide the requested information to the applicant<br \/>\n            held by him.\n<\/p>\n<p>   (c)      Also direct Shri P. K. Mishra, PIO DOPT to provide the<br \/>\n            above information free of cost as the same has not been<br \/>\n            provided within the stipulated time period.\n<\/p>\n<p>   (d)      Pass such further order or orders as Hon&#8217;ble commission<br \/>\n            may deemed fit and proper for protection of rights of any<br \/>\n            applicants seeking information under RTI Act in DOPT.\n<\/p>\n<p>   (e)       Impose deterrent penalty on defaulter as provided in the act<br \/>\n            so that there is complete compliance of the provisions of the<br \/>\n            Act within DOPT.\n<\/p>\n<p>   (f)      Allow due cost and compensation to applicant as provided in<br \/>\n            the Act.&#8221;\n<\/p>\n<p>         This was followed by a request of 1-7-08 from appellant Shri Prem<br \/>\nSingh that he may be exempted from appearance in the hearing.                  We<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><br \/>\n subsequently received a response to our appeal notice from Ms. Anuradha S.<br \/>\nChagti, OSD (RTI) DoPT through her letter of 14-7-08 wherein she submits as<br \/>\nfollows:\n<\/p>\n<blockquote><p>           1. &#8220;Section 24 (2) of the RTI Act, 2005 empowers Govt. to<br \/>\n              carry out amendments in the Second Schedule to the Act.<br \/>\n              The decision to this effect is taken after examining the<br \/>\n              request for such inclusion received from an organization.<br \/>\n              Government is also empowered to review the Schedule<br \/>\n              under the section. Recently, notification dated 28.3.2008<br \/>\n              has been issued incorporating 2 organisation and<br \/>\n              omitting 3 organisations from the Schedule. A copy of<br \/>\n              the notification is attached. In case of NRDB, Ministry of<br \/>\n              Defence had requested for exemption of the organization<br \/>\n              which was examined in consultation with Ministry of<br \/>\n              Home Affairs. Copies of both the communications are<br \/>\n              enclosed. Approval of the competent authority is taken<br \/>\n              for making such amendment and the notification issued is<br \/>\n              also laid on the Table of both the Houses of the<br \/>\n              Parliament. NRDB has been included in the Second<br \/>\n              Schedule from the security point of view. Copies of the<br \/>\n              constitution of the organization (as per information in its<br \/>\n              website) are enclosed. Government has under the power<br \/>\n              vested under Section 24 included the organization after<br \/>\n              considering all aspects.\n<\/p><\/blockquote>\n<blockquote><p>           2. Reply to the application dated 5th September 2006 was<br \/>\n              furnished by the then CPIO vide letter of even number<br \/>\n              dated October 9, 2006 as per the provisions of the RTI<br \/>\n              Act, 2005. However, the appeal dated 20.12.2006 does<br \/>\n              not seem to have been received in this Department.&#8221;<\/p><\/blockquote>\n<p>       A copy of this response together with its enclosures has also been<br \/>\nendorsed to appellant Shri Prem Singh.\n<\/p>\n<p>The appeal was heard on 17-7-08. The following are present:\n<\/p>\n<blockquote><p>       Respondent<br \/>\n       Ms Anuradha S. Chagti, OSD (RTI)<br \/>\n       Shri D. C. Sharma, SO (IR)<\/p>\n<p>      We have noted the request of 1-7-08 from appellant Shri Prem Singh<br \/>\nthat he be exempted from appearance in the hearing<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>       Having heard respondents and perused the record we find that the<br \/>\nresponse of CPIO is not in keeping with the law. Under Section 7 sub-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                       3<\/span><\/p>\n<p> section (9) of the RTI Act &#8220;an information shall ordinarily be provided in the<br \/>\nform in which it is sought.&#8221;\n<\/p>\n<p>       In this case CPIO Shri P. K. Mishra in his initial response has simply<br \/>\nprovided a bald statement to appellant without caring to respond point wise.<br \/>\nWhere copies of documents have been sought it has not been clarified<br \/>\nwhether such documents are held by the public authority or not. Although this<br \/>\ncould have been rectified in the first appeal, that appeal does not seem to<br \/>\nhave been received in the Ministry. At any rate a detailed response has now<br \/>\nbeen provided through her letter of 14.7.2008 submitted by OSD, RTI Ms<br \/>\nAnuradha S. Chagti in response to our appeal notice. This answers all the<br \/>\nquestions raised by the appellant in his original application, even though it<br \/>\ndoes not address each question point wise, as it should have done.\n<\/p>\n<p>       The request of appellant now having been met, this appeal may be<br \/>\nconsidered disposed of.\n<\/p>\n<p>      Announced in the hearing.
