Shailaja learned counsel waives service on behalf of the<br \/>\nrespondents. With the consent of learned counsel for both the sides,<br \/>\nthe matter is taken up for final hearing.\n<\/p>\n<p>1.\tThis<br \/>\nintra-Court Letters Patent Appeal has been filed against the order<br \/>\ndated 26.07.2011 passed by the learned Single Judge in Special Civil<br \/>\nApplication No.6286 of 2011 whereby, the learned Single Judge<br \/>\ndismissed the writ petition with cost of Rs.35,000\/-.\n<\/p>\n<p>2.\tWe<br \/>\nhave heard Mr. BR Gupta learned counsel for the appellant and Ms. E.<br \/>\nShailaja learned counsel for the respondents. The main contention<br \/>\nraised by the appellant is that inquiry proceedings u\/s.7-A of the<br \/>\nE.P.F. Act is sought to be initiated against the appellant, without<br \/>\nconsidering the objections tendered by the employees of the<br \/>\nContractors and also ignoring the fact that the concerned workmen<br \/>\nhave withdrawn their complaints. Therefore, no cause of action<br \/>\nsurvives.\n<\/p>\n<p>3.\tHaving<br \/>\ngone through the record, we find that the authority concerned has so<br \/>\nfar not come to any conclusion in connection with the impugned<br \/>\ninquiry purportedly initiated u\/s.7-A of the said Act. Therefore, it<br \/>\nwould not be appropriate for us to interfere with the inquiry<br \/>\nproceedings at this stage. However, so far as the order passed by the<br \/>\nlearned Single Judge is concerned, we find that the observations made<br \/>\ntherein regarding the conduct of the learned counsel on record, who<br \/>\nappeared for the appellant in the writ petition, are unwarranted and<br \/>\ntherefore, the same are expunged.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, the appeal is allowed to the extent that the order<br \/>\npassed by the learned Single Judge dated 26.07.2011 in Special Civil<br \/>\nApplication No.6286 of 2011 is quashed and set aside. The<br \/>\nrespondent-authority may proceed with the impugned inquiry<br \/>\npurportedly initiated u\/s.7A of the said Act, only after considering<br \/>\nthe submissions \/ objections that shall be raised by the workmen. The<br \/>\nappeal stands disposed of accordingly. Direct service permitted.<br \/>\nConsequently, the civil application also stands disposed of.\n<\/p>\n<p>\t\t\t\t\t\t[V.\n<\/p>\n<p>M.
