Justice M.RAMACHANDRAN\n\n Dated :23\/01\/2007\n\n O R D E R\n                    (V.K.BALI, C.J &amp;  M.RAMACHANDRAN, J)\n\n             ----------------------------------------------------------------\n\n\n                         W.P.(C).No.22635  of 2006-S\n\n\n         -----------------------------------------------------------------\n\n                Dated this the 23rd  day of January, 2007\n\n\n                                    JUDGMENT\n<\/pre>\n<p>Ramachandran, J:\n<\/p>\n<\/p>\n<p>       M\/s.Devi Agencies had obtained a letter of intent from<\/p>\n<p>Bharat Petroleum Corporation   for starting a Fuel Outlet at<\/p>\n<p>Cheruvathur  Village, in  properties  situated  in  R.S.421\/2A1,<\/p>\n<p>adjoining   National   Highway-17.                          Installation   work<\/p>\n<p>apparently is found as delayed, because of the order of the<\/p>\n<p>District   Collector,   when   he   had   been   informed   that   the<\/p>\n<p>Assistant   Executive   Engineer,   National   highways   had<\/p>\n<p>instructed   concerned   persons   to   relocate   the   proposed<\/p>\n<p>bunk.   But, such orders were  stayed, and it is evident that<\/p>\n<p>the outlet has become functional.\n<\/p>\n<\/p>\n<p>       2.          As   could   be   gatherable   from   the   number   of<\/p>\n<p>petitions   filed,   the   petitioner   was   attempting   to   prevent   it<\/p>\n<p>from becoming operational.  It could be seen that three writ<\/p>\n<p>petitions   had   been   filed   earlier.   Objections   that   had   been<\/p>\n<p>raised by the petitioner have been directed to be looked into<\/p>\n<p><span class=\"hidden_text\">[WPC No.22635 of 2006]                 -2-<\/span><\/p>\n<p>and the petitioner was aggrieved in that due attention to the<\/p>\n<p>details were not gone into and the fuel station is functioning<\/p>\n<p>in violation of the norms that are binding on all.  He claims to<\/p>\n<p>be   a   social  activist  &#8220;involved   in   crusade   against   the   corrupt<\/p>\n<p>practices&#8221;.\n<\/p>\n<\/p>\n<p>       3.      The   principal   contention   highlighted   was  that   in<\/p>\n<p>order to set up a fuel station adjacent to National Highways,<\/p>\n<p>the   requirement   of   minimum   distance   prescribed   by   the<\/p>\n<p>relevant   norms   from   an   intersection   was   not   taken   into<\/p>\n<p>consideration.   This was likely to pose danger to all. It was a<\/p>\n<p>case where permission could not have been granted. Rightly,<\/p>\n<p>the   National   Highway   authorities   had   not   given   sanction   or<\/p>\n<p>permission   for   the   installation.     No   Objection   Certificates<\/p>\n<p>were not procured in time and the Fuel Outlet by its location<\/p>\n<p>causes threat to the motorists as also  pedestrians  because of<\/p>\n<p>the proximity to the intersection.\n<\/p>\n<\/p>\n<p>       4.      It   may   not   be   necessary,   at   this   juncture,   to   go<\/p>\n<p>into further details, as technical appraisal was required at all<\/p>\n<p>times.     Presently,   the   Standing   Counsel   for   the   Bharat<\/p>\n<p>Petroleum   Corporation had made available for our perusal a<\/p>\n<p>communication issued by the Executive Engineer, Ministry of<\/p>\n<p><span class=\"hidden_text\">[WPC No.22635 of 2006]                -3-<\/span><\/p>\n<p>Shipping,   Road   Transport   and   Highways,   dated   04-01-2007,<\/p>\n<p>which   indicates   that   No   Objection   Certificate     in   respect   of<\/p>\n<p>the present outlet run by the first respondent has come.  After<\/p>\n<p>examining   the   Licence   Deed   and   other   related   papers,   the<\/p>\n<p>Ministry  of  Transport has  found no  objectionable  features in<\/p>\n<p>erecting the outlet.   Licence deed and lay out plan has been<\/p>\n<p>countersigned.   Of  course, the   requisite  fee   is  to  be  remitted<\/p>\n<p>as a precondition for  No Objection Certificate, but it has been<\/p>\n<p>made   clear   by   the   authority   concerned   that   the   situation   of<\/p>\n<p>the outlet is not objectionable.\n<\/p>\n<\/p>\n<p>       5.      In the aforesaid circumstances, being a technical<\/p>\n<p>matter, and since the outlet has become functional, no further<\/p>\n<p>probe   is   necessary.     The   petitioner   had   brought   to   the<\/p>\n<p>attention   of   the   court   the   lapses   of   authorities,   and   as   a<\/p>\n<p>consequence, follow up steps have been taken to examine the<\/p>\n<p>matter thoroughly.   In addition thereto, we do not think it is<\/p>\n<p>necessary to go into any other details.  The letter dated 04-01-<\/p>\n<p>2007, referred to earlier, will form part of the records. The lay<\/p>\n<p>out plans require strictly to be followed.<\/p>\n<p><span class=\"hidden_text\">[WPC No.22635 of 2006]                         -4-<\/span><\/p>\n<p>        The writ petition will stand closed.
