No. 3919 of 2008\n           -------------------------------------------------\n         Dated this the 20th day of October, 2008\n\n                              ORDER\n<\/pre>\n<p>      The petitioners face allegations in a crime registered<\/p>\n<p>alleging the offence punishable under Section 498A I.P.C. The<\/p>\n<p>crime has been registered on the basis of a private complaint<\/p>\n<p>filed by the second respondent\/de facto complainant.           The<\/p>\n<p>petitioners are the husband, mother-in-law and father-in-law<\/p>\n<p>respectively of the de facto complainant. The crime has been<\/p>\n<p>registered on the basis of a private complaint filed before the<\/p>\n<p>learned Magistrate and referred to the police under Section<\/p>\n<p>156(3) Cr.P.C. Investigation is in progress.<\/p>\n<p>      2. At this stage, the petitioners have come to this court<\/p>\n<p>along with the de facto complainant to apprise this court of the<\/p>\n<p>fact that they have settled all their outstanding disputes.<\/p>\n<p>Harmonious cohabitation has been resumed by the spouses<\/p>\n<p>and, in these circumstances, the second respondent has no<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 3919 of 2008 -: 2 :-<\/span><\/p>\n<p>intention to proceed against the petitioners.             She has<\/p>\n<p>compounded the offence allegedly committed by all the<\/p>\n<p>petitioners.   She has filed an affidavit duly attested by an<\/p>\n<p>advocate to confirm that the disputes have been settled and the<\/p>\n<p>offence alleged has been compounded.<\/p>\n<p>      3.   The learned counsel pray that in the light of the<\/p>\n<p>settlement and composition and in the wake of the decision in<\/p>\n<p>B.S. Joshy v. State of Haryana (AIR 2003 SC 1386), powers<\/p>\n<p>under Section 482 Cr.P.C. may be invoked to quash the<\/p>\n<p>proceedings against the petitioners.<\/p>\n<p>         4.  Notice was given to the learned Public Prosecutor.<\/p>\n<p>He raises no objection. The counsel for the respondent\/de facto<\/p>\n<p>complainant vouches for the signature of the de facto<\/p>\n<p>complainant in the affidavit.\n<\/p>\n<p>         5. I am satisfied that this is an eminently fit case where<\/p>\n<p>the powers under Sec.482 Cr.P.C. as enabled by the dictum in<\/p>\n<p>B.S. Joshy can be invoked and premature termination of<\/p>\n<p>proceedings can be brought about.\n<\/p>\n<p>      6. In the result:\n<\/p>\n<p>      (a) This Crl.M.C. is allowed.\n<\/p>\n<p>      (b) Crime No.66\/08 of the Killikolloor Police Station in<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 3919 of 2008 -: 3 :-<\/span><\/p>\n<p>which the petitioners are the accused and the 2nd respondent is<\/p>\n<p>the de facto complainant is hereby quashed.<\/p>\n<p>                                                 Sd\/-\n<\/p>\n<p>\n                                      (R.
